  1.1                          A bill for an act 
  1.2             relating to retirement; authorizing the Minneapolis 
  1.3             police relief association to conduct a referendum of 
  1.4             its members in accordance with certain procedures; 
  1.5             amending Minnesota Statutes 2000, section 423B.05, by 
  1.6             adding a subdivision. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2000, section 423B.05, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 4.  [REFERENDUM.] (a) The directors of the 
  1.11  Minneapolis police relief association are authorized to submit 
  1.12  the following two questions to its members in a binding 
  1.13  referendum conducted by mail: 
  1.14     "1.  Shall the bylaws of the Minneapolis police relief 
  1.15  association be amended to codify the existing practice of 
  1.16  conducting the election of directors by a mailed-in written 
  1.17  ballot? 
  1.18                                     Yes .......
  1.19                                     No ........"
  1.20                                   and 
  1.21     "2.  Shall the bylaws of the Minneapolis police relief 
  1.22  association be amended to allow future proposed amendments to 
  1.23  the bylaws to be conducted by a vote by mail? 
  1.24                                     Yes .......
  1.25                                     No ........"
  1.26     The association shall conduct the referendum by mailing the 
  2.1   questions and ballots to all members in accordance with the 
  2.2   voting procedures the association used in its last election of 
  2.3   directors. 
  2.4      Prior to submitting the referendum questions to a vote by 
  2.5   the members, the board of directors shall solicit members' 
  2.6   opinions both for and against the questions.  The executive 
  2.7   director of the association shall fairly and impartially 
  2.8   summarize the members' comments for and against the questions.  
  2.9   The summary prepared by the executive director shall be included 
  2.10  with the questions and ballots mailed to the members. 
  2.11     In order to be adopted, a question must receive a favorable 
  2.12  vote of two-thirds of the members voting on a question. 
  2.13     (b) If the second question is approved in the referendum, 
  2.14  future bylaw amendments will be conducted in the same manner 
  2.15  provided for in subdivision 1. 
  2.16     Sec. 2.  [EFFECTIVE DATE.] 
  2.17     Section 1 is effective the day following final enactment.
