A bill for an act
relating to education; allowing schools to maintain a supply of oxygen; proposing
coding for new law in Minnesota Statutes, chapter 121A.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin Districts and schools permitted to maintain supply. new text end

new text begin (a) Districts and
schools may obtain and possess medical oxygen to be maintained and administered by a
school nurse or properly trained personnel to a student or other individual in an emergency
situation.

new text begin (b) A district or school that stores medical oxygen must label and store the oxygen in
compliance with the United States Food and Drug Administration and Occupational Safety
and Health Administration regulations and guidance.

new text begin Arrangements with manufacturers. new text end

new text begin A district or school may enter into
arrangements with licensed manufacturers and distributors of oxygen and oxygen
administration equipment at fair-market, free, or reduced prices. A third party, other than
a manufacturer or supplier, may pay for a school's supply of oxygen and oxygen
administration equipment.
