  1.1                          A bill for an act 
  1.2             relating to education; providing that a community or 
  1.3             nonprofit organization in the after-school enrichment 
  1.4             grant program must be a charitable organization; 
  1.5             establishing an additional priority for applicants of 
  1.6             after-school enrichment grants; appropriating money; 
  1.7             amending Minnesota Statutes 2000, section 124D.221, 
  1.8             subdivisions 1, 2. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 2000, section 124D.221, 
  1.11  subdivision 1, is amended to read: 
  1.12     Subdivision 1.  [ESTABLISHMENT.] A competitive statewide 
  1.13  after-school enrichment grant program is established to provide 
  1.14  implementation grants to community or nonprofit organizations, 
  1.15  to political subdivisions, or to school-based programs.  A 
  1.16  community or nonprofit organization must be a charitable 
  1.17  organization under section 501(c)(3) of the Internal Revenue 
  1.18  Code of 1986 that is a member of the Minnesota council of 
  1.19  nonprofits or the Minnesota council on foundations and 
  1.20  registered with the attorney general's office.  The commissioner 
  1.21  shall develop criteria for after-school enrichment programs. 
  1.22     Sec. 2.  Minnesota Statutes 2000, section 124D.221, 
  1.23  subdivision 2, is amended to read: 
  1.24     Subd. 2.  [PRIORITY NEIGHBORHOODS.] (a) The commissioner 
  1.25  must give priority to all applicants, except as provided in 
  1.26  paragraph (b), demonstrating a match of $1 of nonpublic funding 
  1.27  for each $1 of the grant amount awarded for the implementation 
  2.1   of an after-school enrichment program. 
  2.2      (b) For grants in Minneapolis and St. Paul, the 
  2.3   commissioner must first give priority to neighborhoods in 
  2.4   this subdivision paragraph and then priority according to 
  2.5   paragraph (a).  In Minneapolis, priority neighborhoods are Near 
  2.6   North, Hawthorne, Sumner-Glenwood, Harrison, Jordan, Powderhorn, 
  2.7   Central, Whittier, Cleveland, McKinley, Waite Park, Sheridan, 
  2.8   Holland, Lyndale, Folwell, and Phillips.  In St. Paul, priority 
  2.9   neighborhoods are Summit-University, Thomas-Dale, North End, 
  2.10  Payne-Phalen, Daytons Bluff, and the West Side.  
  2.11     Sec. 3.  [AFTER-SCHOOL ENRICHMENT GRANTS.] 
  2.12     Subdivision 1.  [DEPARTMENT OF CHILDREN, FAMILIES, AND 
  2.13  LEARNING.] The sums indicated in this section are appropriated 
  2.14  from the general fund to the department of children, families, 
  2.15  and learning for the fiscal years designated. 
  2.16     Subd. 2.  [AFTER-SCHOOL ENRICHMENT GRANTS.] For 
  2.17  after-school enrichment grants according to Minnesota Statutes, 
  2.18  section 124D.221:

  2.21     Any balance in the first year does not cancel but is 
  2.22  available in the second year.
