  1.1                          A bill for an act 
  1.2             relating to retirement; public employees retirement 
  1.3             association; eliminating the requirement that local 
  1.4             elected officials terminate the elected official 
  1.5             employment to qualify for a retirement annuity based 
  1.6             on other public employment; amending Minnesota 
  1.7             Statutes 1998, section 353.29, subdivision 1; 
  1.8             proposing coding for new law in Minnesota Statutes, 
  1.9             chapter 353. 
  1.10  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.11     Section 1.  Minnesota Statutes 1998, section 353.29, 
  1.12  subdivision 1, is amended to read: 
  1.13     Subdivision 1.  [AGE AND ALLOWABLE SERVICE REQUIREMENTS.] 
  1.14  (a) Upon termination of membership, a person to whom paragraph 
  1.15  (b) does not apply, who has attained the normal retirement age, 
  1.16  and who received credit for not less than three years of 
  1.17  allowable service is entitled, upon application, to a retirement 
  1.18  annuity.  
  1.19     (b) A person who is both an elected official and a public 
  1.20  employee in a nonelected capacity, who terminates the nonelected 
  1.21  public employment position, who has attained the normal 
  1.22  retirement age, and who received credit for at least three years 
  1.23  of allowable service is entitled, upon application, to a 
  1.24  retirement annuity. 
  1.25     (c) The retirement annuity under paragraph (a) or (b) is 
  1.26  known as the "normal" retirement annuity. 
  1.27     Sec. 2.  [353.301] [STATUS OF COMBINATION ELECTED OFFICIAL 
  2.1   AND PUBLIC EMPLOYEE AFTER RETIREMENT FROM PUBLIC EMPLOYMENT 
  2.2   POSITION.] 
  2.3      A person who previously was both a local elected official 
  2.4   and a public employee in a nonelected position, who was a member 
  2.5   of the association in both capacities, and who retired from the 
  2.6   association after terminating only the nonelected public 
  2.7   employment position under section 353.29, subdivision 1, 
  2.8   paragraph (b), is no longer eligible to be a member of the 
  2.9   association for the local elected official service. 
  2.10     Sec. 3.  [EFFECTIVE DATE.] 
  2.11     Sections 1 and 2 are effective on the day following final 
  2.12  enactment.
