  1.1                          A bill for an act 
  1.2             relating to liquor; authorizing the cities of 
  1.3             Minneapolis, St. Paul, Duluth, and Bloomington to 
  1.4             adopt ordinances authorizing on-sales during certain 
  1.5             hours; exempting certain sales from on-sale hours 
  1.6             restrictions; amending Minnesota Statutes 1998, 
  1.7             section 340A.504, by adding subdivisions. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1998, section 340A.504, is 
  1.10  amended by adding a subdivision to read: 
  1.11     Subd. 2a.  [CERTAIN DISPENSING EXEMPT.] Where a hotel 
  1.12  possessing an on-sale intoxicating liquor license places 
  1.13  containers of intoxicating liquor in cabinets in hotel rooms for 
  1.14  the use of guests staying in those hotel rooms, and a charge is 
  1.15  made for withdrawals from those cabinets, the dispensing of 
  1.16  intoxicating liquor from those cabinets does not constitute a 
  1.17  sale for purposes of subdivision 2. 
  1.18     Sec. 2.  Minnesota Statutes 1998, section 340A.504, is 
  1.19  amended by adding a subdivision to read: 
  1.20     Subd. 7.  [EXTENDED HOURS FOR ON-SALE.] Notwithstanding 
  1.21  subdivision 2, the cities of Minneapolis, St. Paul, Duluth, and 
  1.22  Bloomington may enact one of the following ordinances: 
  1.23     (a) An ordinance that authorizes the issuance of on-sale 
  1.24  intoxicating liquor licenses that permit the licensee to make 
  1.25  on-sales of intoxicating liquor between the hours of 1 a.m. and 
  1.26  2 a.m. Sunday through Friday and between the hours of 1 a.m. and 
  2.1   2:30 a.m. on Saturday and Sunday.  An ordinance may not limit 
  2.2   licenses issued under this paragraph to a particular geographic 
  2.3   area of the city.  The city enacting the ordinance may issue a 
  2.4   temporary permit to a licensed establishment that authorizes the 
  2.5   establishment to sell intoxicating liquor at on-sale between the 
  2.6   hours of 1 a.m. and 2 a.m. Monday through Friday and 1 a.m. and 
  2.7   2:30 a.m. Saturday and Sunday.  Such a temporary permit may only 
  2.8   be issued to an establishment for the period of time between the 
  2.9   date of issuance and the date on which the establishment's 
  2.10  license under section 340A.404, subdivision 1, expires.  No more 
  2.11  than one permit under this paragraph may be issued to any 
  2.12  establishment.  A permit under this subdivision may be revoked 
  2.13  or suspended in the same manner as a license under section 
  2.14  340A.415. 
  2.15     (b) An ordinance that permits the on-sale of intoxicating 
  2.16  liquor by licensed retail establishments between the hours of 1 
  2.17  a.m. and 2 a.m. Sunday through Friday and between the hours of 1 
  2.18  a.m. and 2:30 a.m. on Saturday and Sunday.  An ordinance under 
  2.19  this paragraph must apply to the entire city and may not be 
  2.20  restricted to a particular geographic area of the city. 
  2.21     Sec. 3.  [EFFECTIVE DATE.] 
  2.22     Sections 1 and 2 are effective the day following final 
  2.23  enactment.
