  1.1                          A bill for an act 
  1.2             relating to traffic regulations; deleting some 
  1.3             particulars about transporting sand, gravel, and the 
  1.4             like; amending Minnesota Statutes 1998, section 
  1.5             169.81, subdivision 5b. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 169.81, 
  1.8   subdivision 5b, is amended to read: 
  1.9      Subd. 5b.  [SECURING LOAD; EXCEPTIONS.] (a) The driver of a 
  1.10  vehicle transporting sand, gravel, aggregate, dirt, lime rock, 
  1.11  silica, or similar material shall ensure that the cargo 
  1.12  compartment of the vehicle is securely covered if:  
  1.13     (1) the vertical distance from the top of an exterior wall 
  1.14  of the cargo compartment to the load, when measured downward 
  1.15  along the inside surface of the wall, is less than six inches; 
  1.16  or 
  1.17     (2) the horizontal distance from the top of an exterior 
  1.18  wall of the cargo compartment to the load is less than two feet. 
  1.19     (b) (a) The driver shall not operate a vehicle to transport 
  1.20  sand, gravel, aggregate, dirt, lime rock, silica, or similar 
  1.21  material in or on any part of the vehicle other than in the 
  1.22  cargo container.  The driver shall clean the vehicle of loose 
  1.23  sand, gravel, aggregate, dirt, lime rock, silica, or similar 
  1.24  material before the vehicle is moved on a road, street, or 
  1.25  highway following loading or unloading.  
  2.1      (c) (b) A driver of a vehicle used to transport garbage, 
  2.2   rubbish, trash, debris, or similar material is not required to 
  2.3   cover the transported material as long as (1) the vehicle is 
  2.4   being operated at a speed less than 30 miles per hour, (2) the 
  2.5   vehicle is not being operated on an interstate highway, and (3) 
  2.6   no part of the load escapes from the vehicle.  A driver shall 
  2.7   immediately retrieve material that escapes from the vehicle, 
  2.8   when safe to do so.
