  1.1                          A bill for an act 
  1.2             relating to motor vehicles; establishing revolving 
  1.3             appropriation to pay for vehicle license plate costs; 
  1.4             making clarifying changes; amending Minnesota Statutes 
  1.5             2000, section 168.381. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 168.381, is 
  1.8   amended to read: 
  1.9      168.381 [MANUFACTURE OF VEHICLE LICENSE NUMBER PLATES; 
  1.10  APPROPRIATIONS.] 
  1.11     Subdivision 1.  [CORRECTIONAL FACILITIES; OTHER 
  1.12  MANUFACTURERS.] (a) License number plates required by law may be 
  1.13  manufactured by the Minnesota correctional facility-St. Cloud, 
  1.14  the Minnesota correctional facility-Stillwater, or other 
  1.15  facility established by law for the confinement of persons 
  1.16  convicted of felony, upon order from the registrar of motor 
  1.17  vehicles, such.  The order to must state the quality of material 
  1.18  desired in such the plates, the plate specifications thereof, 
  1.19  and the amount or number desired.  
  1.20     (b) Should the commissioner of corrections decide not to 
  1.21  supply the required quantity of license plates, or discontinue 
  1.22  the manufacture of plates, the commissioner of public safety is 
  1.23  authorized to seek other suppliers on a competitive basis.  
  1.24     Subd. 2.  [LABORATORY TESTING; COSTS.] (a) Materials 
  1.25  purchased to be used in the manufacture of such motor vehicle 
  2.1   number plates shall must be tested as to conformance with 
  2.2   specifications established by the commissioner of public safety 
  2.3   in a privately operated laboratory service to be designated by 
  2.4   the commissioner.  The cost of such the laboratory shall must be 
  2.5   included in the cost of materials purchased.  
  2.6      (b) The cost of delivery of such number plates to the 
  2.7   commissioner of public safety at places which designated by the 
  2.8   commissioner may designate shall must be included in the 
  2.9   expenses incurred in their manufacture.  
  2.10     Subd. 3.  [SPECIFICATIONS.] The commissioner of public 
  2.11  safety shall establish new or revised specifications for the 
  2.12  material and equipment used in the manufacture of number plates 
  2.13  ordered for manufacture after August 1, 1975, and may from time 
  2.14  to time revise such the specifications,; provided that such 
  2.15  the specifications conform to the requirements of section 168.12.
  2.16  In establishing new or revised specifications, the commissioner 
  2.17  shall consult with and give consideration to the advice and 
  2.18  recommendations of representatives of the Minnesota state 
  2.19  patrol, local police officers' associations, and the county 
  2.20  sheriffs' association.  
  2.21     (c) Subd. 4.  [APPROPRIATIONS.] (a) Money appropriated to 
  2.22  the department of public safety to procure the plates for any 
  2.23  fiscal year or years shall be are available for allotment, 
  2.24  encumbrance, and expenditure from and after the date of the 
  2.25  enactment of such the appropriation.  Materials and equipment 
  2.26  used in the manufacture of such number plates are subject only 
  2.27  to the approval of the commissioner of public safety.  
  2.28     (d) (b) This section contemplates that money to be 
  2.29  appropriated to the department of public safety in order to 
  2.30  carry out the terms and provisions of this section will be 
  2.31  appropriated by the legislature from the highway user tax 
  2.32  distribution fund. 
  2.33     (c) A sum sufficient is appropriated annually from the 
  2.34  highway user tax distribution fund to the commissioner of public 
  2.35  safety to pay the costs of purchasing, delivering, and mailing 
  2.36  motor vehicle license number plates, license plate registration 
  3.1   tabs or stickers, and license plate registration notices.
