  1.1                          A bill for an act 
  1.2             relating to transportation; establishing major 
  1.3             transportation project fund for highway and transit 
  1.4             projects; allocating proceeds from sales tax on motor 
  1.5             vehicles to highway user tax distribution fund and 
  1.6             major transportation project fund; proposing an 
  1.7             amendment to the Minnesota Constitution by adding a 
  1.8             section to article XIV to dedicate revenues from motor 
  1.9             vehicle sales tax to major transportation project 
  1.10            fund; appropriating money; amending Minnesota Statutes 
  1.11            2000, section 297B.09, subdivision 1; proposing coding 
  1.12            for new law in Minnesota Statutes, chapter 174. 
  1.13  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.14     Section 1.  [174.91] [MAJOR TRANSPORTATION PROJECT FUND.] 
  1.15     Subdivision 1.  [FUND ESTABLISHED.] A major transportation 
  1.16  project fund is created in the state treasury.  The fund 
  1.17  consists of money credited under section 297B.09 and other money 
  1.18  credited to the fund by law. 
  1.19     Subd. 2.  [ALLOCATION OF REVENUE.] The money in the major 
  1.20  transportation project fund is annually appropriated to the 
  1.21  commissioner of transportation for expenditure as follows: 
  1.22     (a) Eighty percent must be spent by the commissioner on 
  1.23  major highway projects in consultation with the major 
  1.24  transportation projects commission.  These funds must be used 
  1.25  for project development and construction. 
  1.26     (b) The remaining 20 percent must be spent in the operation 
  1.27  of buses and construction of bus transit ways. 
  1.28     Sec. 2.  Minnesota Statutes 2000, section 297B.09, 
  1.29  subdivision 1, is amended to read: 
  2.1      Subdivision 1.  [GENERAL FUND SHARE TAX PROCEEDS 
  2.2   DEPOSITED.] Money collected and received under this chapter must 
  2.3   be deposited as provided in this subdivision.  
  2.4      Thirty-two Thirty-five percent of the money collected and 
  2.5   received must be deposited in the highway user tax distribution 
  2.6   fund, and the remaining 68 65 percent of the money must be 
  2.7   deposited in the general major transportation project fund. 
  2.8      Sec. 3.  [CONSTITUTIONAL AMENDMENT PROPOSED.] 
  2.9      An amendment to the Minnesota Constitution is proposed to 
  2.10  the people.  If the amendment is adopted, a section will be 
  2.11  added to article XIV, to read: 
  2.12     Sec. 12.  At least 65 percent of the net proceeds from any 
  2.13  tax on the sale of new and used motor vehicles must be deposited 
  2.14  in a major transportation project fund for highway and bus 
  2.15  transit purposes. 
  2.16     Sec. 4.  [SUBMISSION TO VOTERS.] 
  2.17     The constitutional amendment proposed in section 3 must be 
  2.18  submitted to the people at the 2002 general election.  The 
  2.19  question submitted must be: 
  2.20     "Shall the Minnesota Constitution be amended to require 
  2.21  that at least 65 percent of the revenue from the motor vehicle 
  2.22  sales tax be deposited in a major transportation project fund 
  2.23  for highway and bus transit purposes? 
  2.24                                     Yes .......
  2.25                                     No ........"
  2.26     Sec. 5.  [EFFECTIVE DATE.] 
  2.27     Sections 1 to 3 are effective July 1, 2003; except that if 
  2.28  the constitutional amendment proposed in section 4 is not 
  2.29  adopted at the 2002 general election, sections 1 to 3 shall not 
  2.30  take effect.
