A bill for an act
relating to human services; establishing permanent increases in reimbursement
rates for qualified early intensive development and behavioral intervention
providers; appropriating money; amending Minnesota Statutes 2022, section
256B.0949, by adding subdivisions.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2022, section 256B.0949, is amended by adding a subdivision
to read:

commissioner of human services shall increase payment rates by 20 percent over the rates
in effect on June 30, 2023, for autism spectrum disorder treatment services covered under
subdivision 13 provided on or after July 1, 2023, by early intensive development and
behavioral intervention providers qualified under subdivision 15.

new text begin This section is effective July 1, 2023, or upon federal approval,
whichever is later. The commissioner of human services shall notify the revisor of statutes
when federal approval is obtained.

Sec. 2.

Minnesota Statutes 2022, section 256B.0949, is amended by adding a subdivision
to read:

shall develop a rate framework for autism spectrum disorder treatment services covered
under subdivision 13 and provided by early intensive development and behavioral
intervention providers qualified under subdivision 15.

Minnesota Statutes 2022, section 256B.0949, is amended by adding a subdivision
to read:

new text begin Beginning January 1, 2024, and annually thereafter,
the commissioner shall adjust the rates for autism spectrum disorder treatment services
covered under subdivision 13 and provided by early intensive development and behavioral
intervention providers qualified under subdivision 15. The commissioner shall include an
inflationary adjustment in the annual adjustment.
