A bill for an act
relating to public utilities; providing for recovery of costs to be incurred as result
of a qualified emissions-reduction project; amending Minnesota Statutes 2006,
section 216B.1692, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2006, section 216B.1692, is amended by adding a
subdivision to read:

new text begin (a) Notwithstanding section
465.717, the St. Paul Port Authority may create a not-for-profit corporation for purposes
of owning or operating, or both, an energy center that uses a preponderance of eligible
energy technologies and serves a facility that has consumed thermal energy generated at a
large coal-fired electric generating power plant that is or will be replaced as part of the
metropolitan emissions-reduction project previously approved by the commission.

new text begin (b) At the written request of the St. Paul Port Authority, the public utility that
submitted the proposal for the emissions-reduction rider to recover the costs of the
project described in paragraph (a) shall include in the emissions-reduction rider used
to recover the costs of this project an additional amount to provide for the collection
of a renewable energy transition charge of $20,000,000 on account of the replacement
energy center described in paragraph (a), and must be paid on collection to the St. Paul
Port Authority. The St. Paul Port Authority shall use the $20,000,000 to pay costs
incurred in the development or construction, or both, of the replacement energy center
described in paragraph (a). The inclusion of the additional $20,000,000 in the public
utility's emissions-reduction rate rider must be considered to be part of the original
emissions-reduction project.
