  1.1                          A bill for an act 
  1.2             relating to agricultural land; providing an exemption 
  1.3             from certain regulations; providing a waiver from 
  1.4             liability for certain landowners; amending Minnesota 
  1.5             Statutes 2000, section 116.07, by adding a 
  1.6             subdivision; proposing coding for new law in Minnesota 
  1.7             Statutes, chapter 17.  
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  [17.1395] [TRESPASS; LIABILITY OF OWNER.] 
  1.10     Notwithstanding any law or rule to the contrary, an owner 
  1.11  or legal occupier of agricultural land is not liable to any 
  1.12  person for a claim arising during the person's physical presence 
  1.13  on the agricultural land unless the person was, at the time of 
  1.14  the presence, in possession of written permission from the owner 
  1.15  or occupier authorizing the person to be present on the land. 
  1.16     Sec. 2.  Minnesota Statutes 2000, section 116.07, is 
  1.17  amended by adding a subdivision to read: 
  1.18     Subd. 7d.  [EXEMPTION.] Notwithstanding section 116.07, 
  1.19  subdivision 7, or other law or rule to the contrary, and 
  1.20  notwithstanding the proximity to public or private waters, an 
  1.21  owner or resident of agricultural land on which livestock have 
  1.22  been allowed to pasture at any time during the ten-year period 
  1.23  beginning January 1, 1990, is permanently exempt from 
  1.24  requirements related to feedlot or manure management on that 
  1.25  land.
