1.1 A bill for an act 1.2 relating to transportation; making seat belt violation 1.3 a primary offense; requiring all passengers to wear 1.4 seat belt; imposing petty misdemeanor penalty; 1.5 amending Minnesota Statutes 2000, section 169.686, 1.6 subdivision 1. 1.7 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.8 Section 1. Minnesota Statutes 2000, section 169.686, 1.9 subdivision 1, is amended to read: 1.10 Subdivision 1. [SEAT BELT REQUIREMENT.] (a) A properly 1.11 adjusted and fastened seat belt, including both the shoulder and 1.12 lap belt when the vehicle is so equipped, shall be worn by:1.13(1)the driver and passengers of a passenger vehicle or 1.14 commercial motor vehicle;1.15(2) a passenger riding in the front seat of a passenger1.16vehicle or commercial motor vehicle; and1.17(3) a passenger riding in any seat of a passenger vehicle1.18who is older than three but younger than 11 years of age. 1.19 (b) A person who is 15 years of age or older and who 1.20 violates paragraph (a), clause (1) or (2),issubject to a fine1.21of $25guilty of a petty misdemeanor. The driver of 1.22 thepassenger vehicle or commercial motorvehicle in which the 1.23 violation occurred issubject to a $25 fineguilty of a petty 1.24 misdemeanor for a violation of paragraph (a), clause (2) or (3),1.25 by achild of the driverpassenger under the age of 15or any1.26child under the age of 11. A peace officer may not issue a2.1citation for a violation of this section unless the officer2.2lawfully stopped or detained the driver of the motor vehicle for2.3a moving violation other than a violation involving motor2.4vehicle equipment. The department of public safety shall not 2.5 record a violation of this subdivision on a person's driving 2.6 record.
