  1.1                          A bill for an act
  1.2             relating to human services; authorizing an exception 
  1.3             to the maximum reimbursement rate for certain group 
  1.4             residential housing facilities; removing a sunset on 
  1.5             eligibility for certain state programs; appropriating 
  1.6             money; amending Minnesota Statutes 1998, section 
  1.7             256I.05, by adding a subdivision; Laws 1997, chapter 
  1.8             203, article 9, section 21, as amended. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1998, section 256I.05, is 
  1.11  amended by adding a subdivision to read: 
  1.12     Subd. 1e.  [SUPPLEMENTARY RATE FOR CERTAIN FACILITIES.] 
  1.13  Notwithstanding the provisions of subdivisions 1a and 1c, 
  1.14  beginning July 1, 1999, a county agency may negotiate a 
  1.15  supplementary rate in addition to the rate specified in 
  1.16  subdivision 1, up to the amount specified in subdivision 1a, for 
  1.17  a group residential housing provider that: 
  1.18     (1) is located in Hennepin county and has had a group 
  1.19  residential housing contract with the county since June 1996; 
  1.20     (2) operates in three separate locations a 56-bed facility, 
  1.21  a 40-bed facility, and a 30-bed facility; and 
  1.22     (3) serves a chemically dependent clientele, providing 24 
  1.23  hours per day supervision and limiting a resident's maximum 
  1.24  length of stay to 13 months out of a consecutive 24-month period.
  1.25     Sec. 2.  Laws 1997, chapter 203, article 9, section 21, as 
  1.26  amended by Laws 1998, chapter 407, article 6, section 111, is 
  1.27  amended to read: 
  2.1      Sec. 21.  [INELIGIBILITY FOR STATE FUNDED PROGRAMS.] 
  2.2      (a) Beginning July 1, 2000, the following persons will be 
  2.3   ineligible for general assistance and general assistance medical 
  2.4   care under Minnesota Statutes, chapter 256D, group residential 
  2.5   housing under Minnesota Statutes, chapter 256I, and MFIP-S 
  2.6   assistance under Minnesota Statutes, chapter 256J, funded with 
  2.7   state money: 
  2.8      (1) persons who are terminated from or denied Supplemental 
  2.9   Security Income due to the 1996 changes in the federal law 
  2.10  making persons whose alcohol or drug addiction is a material 
  2.11  factor contributing to the person's disability ineligible for 
  2.12  Supplemental Security Income, and are eligible for general 
  2.13  assistance under Minnesota Statutes, section 256D.05, 
  2.14  subdivision 1, paragraph (a), clause (17), general assistance 
  2.15  medical care under Minnesota Statutes, chapter 256D, or group 
  2.16  residential housing under Minnesota Statutes, chapter 256I; 
  2.17     (2) legal noncitizens who are ineligible for Supplemental 
  2.18  Security Income due to the 1996 changes in federal law making 
  2.19  certain noncitizens ineligible for these programs due to their 
  2.20  noncitizen status; and 
  2.21     (3) (2) legal noncitizens who are eligible for MFIP-S 
  2.22  assistance, either the cash assistance portion or the food 
  2.23  assistance portion, funded entirely with state money. 
  2.24     (b) State money that remains unspent due to changes in 
  2.25  federal law enacted after May 12, 1997, that reduce state 
  2.26  spending for legal noncitizens or for persons whose alcohol or 
  2.27  drug addiction is a material factor contributing to the person's 
  2.28  disability, or enacted after February 1, 1998, that reduce state 
  2.29  spending for food benefits for legal noncitizens shall not 
  2.30  cancel and shall be deposited in the TANF reserve account. 
  2.31     Sec. 3.  [APPROPRIATION.] 
  2.32     $....... is appropriated from the general fund to the 
  2.33  commissioner of human services for the biennium ending June 30, 
  2.34  2001, for the purposes of sections 1 and 2.
