  1.1                          A bill for an act 
  1.2             relating to public safety; requiring licensure of fire 
  1.3             investigators; directing revisor to make technical 
  1.4             change; amending Minnesota Statutes 1998, sections 
  1.5             326.32, by adding a subdivision; and 326.338, 
  1.6             subdivision 1. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1998, section 326.32, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 6a.  "Fire investigator" means a person who conducts 
  1.11  a careful search, examination, or systematic inquiry, and 
  1.12  conducts any further investigation required, to determine 
  1.13  origin, cause, and responsibility for a fire or explosion. 
  1.14     Sec. 2.  Minnesota Statutes 1998, section 326.338, 
  1.15  subdivision 1, is amended to read: 
  1.16     Subdivision 1.  [PRIVATE DETECTIVE.] Persons who for a fee, 
  1.17  reward, or other consideration, undertake any of the following 
  1.18  acts for the purpose of obtaining information for others are 
  1.19  considered to be engaged in the business of a private detective: 
  1.20     (1) investigating crimes or wrongs done or threatened 
  1.21  against the government of the United States or of any state, 
  1.22  county, or municipal subdivision thereof; 
  1.23     (2) investigating the identity, habits, conduct, movements, 
  1.24  whereabouts, transactions, reputation, or character of any 
  1.25  person or organization; 
  1.26     (3) investigating the credibility of witnesses or other 
  2.1   persons; 
  2.2      (4) investigating the location or recovery of lost or 
  2.3   stolen property; 
  2.4      (5) investigating the origin of and responsibility for 
  2.5   libels, losses, accidents, or damage or injuries to persons or 
  2.6   property, including, but not limited to, the investigation of 
  2.7   fires or explosions; 
  2.8      (6) investigating the affiliation, connection, or 
  2.9   relationship of any person, firm, or corporation with any 
  2.10  organization, society, or association, or with any official, 
  2.11  representative, or member thereof; 
  2.12     (7) investigating the conduct, honesty, efficiency, 
  2.13  loyalty, or activities of employees, persons seeking employment, 
  2.14  agents, or contractors and subcontractors; 
  2.15     (8) obtaining through investigation evidence to be used 
  2.16  before any authorized investigating committee, board of award, 
  2.17  board of arbitration, administrative body, or officer or in 
  2.18  preparation for trial of civil or criminal cases; or 
  2.19     (9) investigating the identity or apprehension of persons 
  2.20  suspected of crimes or misdemeanors. 
  2.21     Sec. 3.  [INSTRUCTION TO REVISOR.] 
  2.22     In the next edition of Minnesota Statutes, the revisor of 
  2.23  statutes shall renumber Minnesota Statutes, section 326.32, 
  2.24  subdivision 5 as subdivision 3a, and subdivision 8 as 
  2.25  subdivision 1b.  The revisor of statutes shall make any 
  2.26  cross-reference corrections necessary due to this renumbering 
  2.27  instruction.
