A bill for an act
relating to education; fostering educational innovation to improve student and
school performance; amending Minnesota Statutes 2008, section 126C.10,
subdivision 2; proposing coding for new law in Minnesota Statutes, chapter
120B.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin A school district must use five percent of the basic revenue it receives each year to
incorporate peer-reviewed, research-based curriculum, instruction, and other education
measures and practices to improve students' academic performance that it demonstrates
using a growth-based value-added assessment model under this chapter. A school district
that fails to demonstrate student improvement sufficient to meet expected levels of student
academic growth and achievement must file a plan with the commissioner that describes
how the district proposes to use its innovation revenue. Once the commissioner approves
the district's plan, the district must spend its innovation revenue consistent with that plan.

Sec. 2.

Minnesota Statutes 2008, section 126C.10, subdivision 2, is amended to read:


Subd. 2.

Basic revenue.

The basic revenue for each district equals the formula
allowance times the adjusted marginal cost pupil units for the school year. The formula
allowance for fiscal year 2007 is $4,974. The formula allowance for fiscal year 2008 is
