  1.1                          A bill for an act 
  1.2             relating to agriculture; regulating pesticide 
  1.3             application in certain schools; amending Minnesota 
  1.4             Statutes 2000, section 18B.01, by adding a 
  1.5             subdivision; proposing coding for new law in Minnesota 
  1.6             Statutes, chapter 18B. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2000, section 18B.01, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 26a.  [SCHOOL PEST MANAGEMENT COORDINATOR.] "School 
  1.11  pest management coordinator" means a person employed by a 
  1.12  Minnesota kindergarten through 12th grade public, private, or 
  1.13  parochial school who is responsible for the planning, training, 
  1.14  coordination, communication, and implementation of a school's 
  1.15  integrated pest management program, including the application of 
  1.16  pesticides to the inside or outdoor property of the school as 
  1.17  part of that program. 
  1.18     Sec. 2.  [18B.095] [PESTICIDE APPLICATION IN SCHOOLS.] 
  1.19     Subdivision 1.  [AUTHORIZED APPLICATORS.] Application of a 
  1.20  pesticide to the inside or outdoor property of a Minnesota 
  1.21  kindergarten through 12th grade public, private, or parochial 
  1.22  school must be performed by: 
  1.23     (1) a structural pest control applicator; 
  1.24     (2) a commercial or noncommercial pesticide applicator with 
  1.25  appropriate use category certification; or 
  1.26     (3) a registered school pest management coordinator or a 
  2.1   school employee with the knowledge of a registered school pest 
  2.2   management coordinator. 
  2.3      Subd. 2.  [EXEMPTION.] Pesticides determined by the 
  2.4   commissioner to be sanitizers or disinfectants are exempt from 
  2.5   subdivision 1. 
  2.6      Subd. 3.  [REGISTRY AND INFORMATION.] The commissioner, in 
  2.7   consultation with the departments of health; administration; and 
  2.8   children, families, and learning; the University of Minnesota 
  2.9   Extension Service; the Minnesota School Boards Association; and 
  2.10  other persons as necessary and appropriate, must: 
  2.11     (1) establish and maintain a registry of school pest 
  2.12  management coordinators; and 
  2.13     (2) provide information on a regular and periodic basis to 
  2.14  registered school pest management coordinators on integrated 
  2.15  pest management techniques and programs, including model school 
  2.16  policies; proper pesticide use, storage, handling, and disposal; 
  2.17  and other relevant pesticide and pest management information. 
  2.18     Sec. 3.  [EFFECTIVE DATE.] 
  2.19     Section 2 is effective August 1, 2002.
