A bill for an act
relating to transportation; modifying provisions relating to permits and to escort
drivers for overdimensional loads; amending Minnesota Statutes 2012, section
169.86, subdivision 3b.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2012, section 169.86, subdivision 3b, is amended to read:


Subd. 3b.

Escort vehicles.

new text begin (a) new text end The commissioner or local authority shall specify
in the permit:

(1) the minimum number of escort vehicles required to escort the overdimensional
load; and

(2) deleted text begin whetherdeleted text end new text begin any requirements relating to flashing warning lights.

new text begin (b) The permit must state that new text end the operators of the escort vehicles deleted text begin mustdeleted text end new text begin :

new text begin (1) maynew text end be certified licensed peace officers or new text begin certified protective agents licensed
under sections 326.32 to 326.339, or both, at the discretion of the applicant; or

new text begin (2) new text end may be overdimensional load escort drivers new text begin who hold a license under section
326.3382, subdivision 5, and
new text end who hold a current certificate under section 299D.085.

new text begin (c) The commissioner of transportation may not adopt a rule or other regulation
that directly or indirectly:

new text begin (1) bars licensed protective agents from performing traffic control duties under
section 326.338, subdivision 4, clause (4); or
new text end

new text begin (2) results in a preference for a licensed peace officer or a licensed protective agent
in the provision of overdimensional load escort services.

new text begin Paragraphs (a) and (b) are effective on the same day as the
effective date of Laws 2010, chapter 311, section 2. Paragraph (c) is effective the day
following final enactment.
