A bill for an act
relating to transportation; providing for oversight and distribution of
transportation funding; requiring Department of Transportation to meet certain
programmatic investment percentages and a certain minimum guarantee of state
highway and bridge funding for all state transportation districts; proposing
coding for new law in Minnesota Statutes, chapter 174.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin (a) The commissioner of transportation shall ensure that all programmed
transportation funding for state highways and bridges within the eight state transportation
districts be consistent with target percentages set for mobility, safety, and system
preservation, as prescribed in the state transportation plan.

new text begin (b) The commissioner shall report annually to the legislature regarding the
consistency of individual state transportation district programs and the overall state
transportation improvement program with approved state transportation plan investment
target percentages.

Sec. 2.

new text begin [174.036] TRANSPORTATION DISTRICT MINIMUM GUARANTEE
PERCENTAGE.

new text begin (a) When distributing trunk highway or bridge funding not otherwise obligated by
legislative directives, the commissioner of transportation shall ensure that each of the eight
state transportation districts receives a minimum guaranteed rate of return for all fuel tax,
license registration tax, and motor vehicle sales tax proceeds contributed by that district to
the highway user tax distribution fund (HUTDF) and deposited in the trunk highway fund.

new text begin (b) The minimum guarantee is set at 92 percent of a district's HUTDF contribution.
This minimum guarantee is the base level of state highway and bridge funding for each
state transportation district on a fiscal year basis.

new text begin (c) Decisions regarding the distribution of state highway and bridge funding beyond
this minimum guarantee base amount must be made at the discretion of the commissioner
of transportation.
