  1.1                          A bill for an act 
  1.2             relating to education; requiring school districts to 
  1.3             provide remedial instruction to students who fail to 
  1.4             meet minimum course requirements in core academic 
  1.5             subjects; requiring a report to project remediation 
  1.6             costs; amending Minnesota Statutes 1998, section 
  1.7             120A.22, subdivision 9. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1998, section 120A.22, 
  1.10  subdivision 9, is amended to read: 
  1.11     Subd. 9.  [CURRICULUM.] (a) Instruction must be provided in 
  1.12  at least the following subject areas:  
  1.13     (1) basic communication skills including reading and 
  1.14  writing, literature, and fine arts; 
  1.15     (2) mathematics and science; 
  1.16     (3) social studies including history, geography, and 
  1.17  government; and 
  1.18     (4) health and physical education.  
  1.19     (b) A school district must provide remedial instruction to 
  1.20  every student in grades 2 through 12 who receives a letter "F" 
  1.21  or its equivalent for failing to meet minimum course 
  1.22  requirements in a core academic subject area listed in paragraph 
  1.23  (a).  A school district must provide remedial instruction to 
  1.24  every student in grades 2 through 12 who receives a letter "D" 
  1.25  or its equivalent for failing to meet minimum course 
  1.26  requirements in a core academic subject area listed in paragraph 
  2.1   (a), if the student's parent, the student's teachers in the 
  2.2   current school year and, where applicable, one or more 
  2.3   elementary school teachers teaching students in the next grade 
  2.4   following the grade in which the student is currently enrolled, 
  2.5   agree that it is in the student's best interest to receive 
  2.6   remedial instruction. 
  2.7      (c) Instruction, textbooks, and materials must be in the 
  2.8   English language.  Another language may be used pursuant to 
  2.9   sections 124D.59 to 124D.61. 
  2.10     Sec. 2.  [REPORT.] 
  2.11     By September 1, 1999, all school districts must identify 
  2.12  and report to the commissioner of children, families, and 
  2.13  learning the number of students who would require remedial 
  2.14  instruction under section 1 based on the students' failure to 
  2.15  meet minimal course requirements in a core academic subject area 
  2.16  during the 1998-1999 school year, and the estimated cost for 
  2.17  that remediation by grade.  The commissioner must report the 
  2.18  compiled data to the education committees of the legislature by 
  2.19  October 15, 1999, in order for the committees to determine the 
  2.20  costs of providing remedial instruction for the 1999-2000 school 
  2.21  year and later. 
  2.22     Sec. 3.  [EFFECTIVE DATE.] 
  2.23     Section 1 is effective for the 1999-2000 school year.  
  2.24  Section 2 is effective the day following final enactment.
