  1.1                          A bill for an act 
  1.2             relating to government data practices; requiring the 
  1.3             revisor of statutes to reorganize and recodify the 
  1.4             data practices law; requiring responsible authorities 
  1.5             to annually provide the revisor of statutes with lists 
  1.6             of statutes pertaining to data practices codified 
  1.7             outside chapter 13; amending Minnesota Statutes 1998, 
  1.8             section 13.05, by adding a subdivision. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  [REVISOR INSTRUCTION; DATA PRACTICES LAW 
  1.11  RECODIFICATION.] 
  1.12     The revisor of statutes shall reorganize Minnesota 
  1.13  Statutes, chapter 13, to create a structure that provides users 
  1.14  with quick access to the data practices laws codified in chapter 
  1.15  13 and locates references to data practices laws codified 
  1.16  outside chapter 13 adjacent to their particular service area 
  1.17  codified in chapter 13.  For purposes of this section, "data 
  1.18  practice laws codified outside chapter 13" includes both laws 
  1.19  that place restrictions on access to data and laws involving 
  1.20  data sharing.  Service areas may include government entities 
  1.21  such as state agencies, cities, or school districts, or 
  1.22  functional areas such as education, law enforcement, human 
  1.23  services, or child protection.  If there is no appropriate 
  1.24  service area in chapter 13, the revisor shall recodify the 
  1.25  provision in another logical and appropriate place in chapter 
  1.26  13.  The revisor shall consult with the chairs of the data 
  1.27  practices subcommittees in the house of representatives and 
  2.1   senate, and legislative staff.  The revisor shall include the 
  2.2   data practices recodification in the 2000 edition of Minnesota 
  2.3   Statutes. 
  2.4      Sec. 2.  Minnesota Statutes 1998, section 13.05, is amended 
  2.5   by adding a subdivision to read: 
  2.6      Subd. 1a.  [REPORT OF DATA PRACTICES STATUTES TO REVISOR 
  2.7   REQUIRED.] As required under Minnesota Rules, part 1205.1500, 
  2.8   subpart 3, the responsible authority shall annually prepare a 
  2.9   list that identifies all statutes binding on that entity that 
  2.10  authorize programs or functions for which data or types of data 
  2.11  are collected, or that authorize the actual collection, storage, 
  2.12  use, or dissemination of data or types of data by the entity, as 
  2.13  defined in Minnesota Rules, part 1205.0200, subpart 6.  The list 
  2.14  must be submitted to the office of the revisor of statutes no 
  2.15  later than September 1 of each year so that the revisor can 
  2.16  prepare a bill for the next legislative session updating 
  2.17  references in chapter 13 to the data practices laws codified 
  2.18  outside chapter 13. 
  2.19     Sec. 3.  [EFFECTIVE DATE.] 
  2.20     Sections 1 and 2 are effective the day after final 
  2.21  enactment.
