  1.1                          A bill for an act 
  1.2             relating to the city of Moorhead; extending authority 
  1.3             to impose a tax levy; amending Laws 2002, chapter 377, 
  1.4             article 11, section 1. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Laws 2002, chapter 377, article 11, section 1, 
  1.7   is amended to read: 
  1.8      Section 1.  [CITY OF MOORHEAD; TAX LEVY AUTHORIZED.] 
  1.9      (a) Each year the city of Moorhead may impose a tax on all 
  1.10  class 3a and class 3b property located in the city in an amount 
  1.11  which the city determines is equal to the reduction in revenues 
  1.12  from increment from all tax increment financing districts in the 
  1.13  city resulting from the class rate changes and the elimination 
  1.14  of the state-determined general education property levy under 
  1.15  Laws 2001, First Special Session chapter 5.  The proceeds of 
  1.16  this tax may only be used to pay preexisting obligations as 
  1.17  defined in Minnesota Statutes, section 469.1763, subdivision 6, 
  1.18  whether general obligations or payable wholly from tax 
  1.19  increments.  The tax must be levied and collected in the same 
  1.20  manner and as part of the property tax levied by the city and is 
  1.21  subject to the same administrative, penalty, and enforcement 
  1.22  provisions.  A tax imposed under this section is a special levy 
  1.23  and is not subject to levy limitations under Minnesota Statutes, 
  1.24  section 275.71. 
  1.25     (b) This section expires December 31, 2005. 
  2.1      [EFFECTIVE DATE.] This section is effective upon approval 
  2.2   by and compliance with Minnesota Statutes, section 645.021, 
  2.3   subdivision 3, by the governing body of the city of Moorhead.
