  1.1                          A bill for an act 
  1.2             relating to border city development zones; authorizing 
  1.3             the city of Taylors Falls and the town of Franconia to 
  1.4             establish zones and exercise border city development 
  1.5             zone powers.  
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [CITY OF TAYLORS FALLS; BORDER CITY DEVELOPMENT 
  1.8   ZONES.] 
  1.9      Subdivision 1.  [AUTHORIZATION.] The governing body of the 
  1.10  city of Taylors Falls may designate between one and three areas 
  1.11  of the city as border city development zones.  The total area of 
  1.12  the zones may not exceed 100 acres. 
  1.13     Subd. 2.  [APPLICATION OF GENERAL LAW.] (a) The provisions 
  1.14  of Minnesota Statutes, sections 469.1731 to 469.1735, apply to 
  1.15  the border city development zones designated under this section. 
  1.16  The governing body of the city may exercise the powers granted 
  1.17  under Minnesota Statutes, sections 469.1731 to 469.1735, 
  1.18  including powers that apply outside of the zones. 
  1.19     (b) The allocation under subdivision 3 for purposes of 
  1.20  Minnesota Statutes, section 469.1735, subdivision 2, and the 
  1.21  necessary amount of the allocation is appropriated to the 
  1.22  commissioner of revenue. 
  1.23     Subd. 3.  [ALLOCATION OF STATE TAX REDUCTIONS.] (a) The 
  1.24  cumulative total amount of tax reductions for all years of the 
  1.25  program under Minnesota Statutes, sections 469.1731 to 469.1735, 
  2.1   for the city of Taylors Falls, is limited to $........ 
  2.2      (b) This allocation may be used for tax reductions provided 
  2.3   in Minnesota Statutes, section 469.1732 or 469.1734, or for 
  2.4   reimbursements under Minnesota Statutes, section 469.1735, 
  2.5   subdivision 3, but only if the governing body of the city of 
  2.6   Taylors Falls determines that the tax reduction or offset is 
  2.7   necessary to enable a business to expand within the city or to 
  2.8   attract a business to the city. 
  2.9      (c) The commissioner of revenue may waive the limit under 
  2.10  this subdivision using the same rules and standards provided in 
  2.11  Minnesota Statutes, section 469.169, subdivision 12, paragraph 
  2.12  (b). 
  2.13     Subd. 4.  [EFFECTIVE DATE.] This section is effective upon 
  2.14  compliance by the governing body of the city of Taylors Falls 
  2.15  with the requirements of Minnesota Statutes, section 645.021. 
  2.16     Sec. 2.  [TOWN OF FRANCONIA; BORDER CITY DEVELOPMENT 
  2.17  ZONES.] 
  2.18     Subdivision 1.  [AUTHORIZATION.] The board of supervisors 
  2.19  of the town of Franconia in Chisago county may designate between 
  2.20  one and three areas of the town as border city development 
  2.21  zones.  The total area of the zones may not exceed 100 acres. 
  2.22     Subd. 2.  [APPLICATION OF GENERAL LAW.] (a) The provisions 
  2.23  of Minnesota Statutes, sections 469.1731 to 469.1735, apply to 
  2.24  the border city development zones designated under this section.
