A bill for an act
relating to health; requiring commissioner of health to develop a uniform
formulary exception document; amending Minnesota Statutes 2008, section
62J.497, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 62J.497, is amended by adding a
subdivision to read:

new text begin Development and use of uniform formulary exception document.

new text begin (a) The commissioner of health, in consultation with the Minnesota Administrative
Uniformity Committee, shall develop a uniform formulary exception document that:

new text begin (1) allows health care providers to request exceptions from group purchaser drug
formularies using a standard form; and
new text end

new text begin (2) effective January 1, 2011, can be accessed by health care providers, and accepted
and processed by group purchasers, electronically through a secure Internet site.

new text begin (b) Beginning July 1, 2009, all health care providers must submit requests for
formulary exceptions to group purchasers using the uniform formulary exception
document, and all group purchasers must accept this document from health care providers.
