A bill for an act
relating to transportation; modifying requirements for noise abatement on
highway construction projects; amending Minnesota Statutes 2008, section
161.125, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 161.125, is amended by adding a
subdivision to read:

new text begin (a) The commissioner shall establish a noise
abatement policy, in conformance with Code of Federal Regulations, title 23, part 772.

new text begin (b) The commissioner shall include in the noise abatement policy an equity-adjusted
cost-effectiveness measure that equals 1.85 multiplied by the cost-effectiveness dollar limit
per residence per decibel reduced. The commissioner shall specify the cost-effectiveness
dollar limit in evaluating reasonable costs of noise abatement. The equity-adjusted
cost-effectiveness measure applies to any noise analysis on a highway construction or
reconstruction project that includes, as a component of the project design, conversion of a
trunk highway from an expressway to a freeway.

and applies to trunk highway construction projects for which the commissioner has not
advertised for bids on or before that effective date.
