A bill for an act
relating to education; qualifying certain homeless children for early educational
services; appropriating money; amending Minnesota Statutes 2014, section
125A.02, subdivision 1a, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2014, section 125A.02, subdivision 1a, is amended to
read:

Subd. 1a.

Children deleted text begin ages deleted text end new text begin under age new text end three deleted text begin through seven deleted text end experiencing
developmental delays.

In addition, new text begin "child with a disability" includes new text end every child under
age three deleted text begin , and at local district discretion from age three to age seven, deleted text end who needs special
instruction and services, as determined by the rules of the commissioner, because the child new text begin :

new text begin (1) new text end has a substantial delay deleted text begin or deleted text end new text begin ;
new text end

new text begin (2) new text end has deleted text begin an identifiable deleted text end new text begin certain diagnosed new text end physical or mental deleted text begin condition known to
hinder normal development is a child with a disability deleted text end new text begin conditions with a high probability
of resulting in a delay, regardless of whether the child is currently demonstrating a need or
delay; or
new text end

new text begin (3) may develop an identifiable condition because the child is homeless new text end .

Sec. 2.

Minnesota Statutes 2014, section 125A.02, is amended by adding a subdivision
to read:

new text begin Children ages three through seven experiencing developmental
delays. new text end

new text begin In addition, "child with a disability" includes, at local discretion, every child from
age three to age seven who needs special instruction and services, as determined by the
rules of the commissioner, because the child:

new text begin (1) has a substantial delay; or
new text end

new text begin (2) has certain diagnosed physical or mental conditions with a high probability of
resulting in a delay, regardless of whether the child is currently demonstrating a need
or delay.

Sec. 3. new text begin APPROPRIATION; HOMELESSNESS.

new text begin Department of Education. new text end

new text begin The sums indicated in this section are
appropriated from the general fund to the Department of Education for the fiscal years
designated.

new text begin For the department to provide training on homelessness
and its associated experiences:

new text begin The department must provide training to Part C early intervention staff members at
the state and school district levels and interagency early intervention committees. Any
balance in the first year does not cancel but is available in the second year.
