  1.1                          A bill for an act 
  1.2             relating to health; restricting the construction of 
  1.3             radiation therapy facilities; proposing coding for new 
  1.4             law in Minnesota Statutes, chapter 144. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [144.5509] [RADIATION THERAPY FACILITY 
  1.7   CONSTRUCTION.] 
  1.8      Notwithstanding any other law to the contrary, a radiation 
  1.9   therapy facility may be constructed only by an entity owned, 
  1.10  operated, or controlled by a hospital licensed according to 
  1.11  sections 144.50 to 144.56 either alone or in cooperation with 
  1.12  another entity. 
  1.13     [EFFECTIVE DATE.] This section is effective the day 
  1.14  following final enactment and applies to construction commenced 
  1.15  on or after that date.  This section expires August 1, 2008.
