  1.1                          A bill for an act 
  1.2             relating to cities; authorizing the city of Bemidji to 
  1.3             exercise the power of eminent domain for acquisition 
  1.4             of certain trust fund land. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [AUTHORIZING EXERCISE OF EMINENT DOMAIN; CITY 
  1.7   OF BEMIDJI.] 
  1.8      (a) Notwithstanding Minnesota Statutes, sections 92.45 and 
  1.9   103F.535, or other law to the contrary, the city council of 
  1.10  Bemidji may exercise the right of eminent domain in the manner 
  1.11  provided by Minnesota Statutes, chapter 117, to acquire the 
  1.12  following trust fund land bordering public waters and wetlands, 
  1.13  except minerals and mineral rights: 
  1.14     That part of Government Lot 2, Section 36, Township 147 
  1.15  North, Range 34 West, Beltrami county, Minnesota, described as 
  1.16  follows: 
  1.17     Beginning at MN/DOT right-of-way marker B4, as shown on 
  1.18  MN/DOT right-of-way plat numbered 04-23 as the same is on file 
  1.19  and of record in the office of the county recorder, Beltrami 
  1.20  county, Minnesota; thence Azimuth of 201 degrees 27 minutes 46 
  1.21  seconds a distance of 690.00 feet to MN/DOT right-of-way marker 
  1.22  B3; thence Azimuth of 291 degrees 27 minutes 46 seconds a 
  1.23  distance of 500.00 feet; thence Azimuth of 21 degrees 27 minutes 
  1.24  46 seconds a distance of 690.00 feet to the southwesterly 
  1.25  right-of-way line of Trunk Highway No. 2; thence Azimuth of 111 
  2.1   degrees 27 minutes 46 seconds along the southwesterly 
  2.2   right-of-way line of Trunk Highway No. 2 a distance of 500.00 
  2.3   feet to said MN/DOT right-of-way marker B4 and there 
  2.4   terminating, containing 7.9 acres.  
  2.5      (b) The city of Bemidji needs the land for economic 
  2.6   development purposes and, in particular, for the construction of 
  2.7   an office and laboratory facility to house the future northern 
  2.8   service center of the bureau of criminal apprehension.  The site 
  2.9   is adjacent to the northwest district headquarters of the 
  2.10  department of transportation. 
  2.11     Sec. 2.  [EFFECTIVE DATE.] 
  2.12     Section 1 is effective the day following final enactment.
