A bill for an act
relating to gambling; requiring the deposit of lottery
proceeds in the county natural resources and
recreation fund; creating a county natural resources
and recreation fund and providing for the distribution
and use of amounts in the fund; amending Minnesota
Statutes 2004, section 349A.10, subdivision 5;
proposing coding for new law in Minnesota Statutes,
chapter 349A.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2004, section 349A.10,
subdivision 5, is amended to read:


Subd. 5.

Deposit of net proceeds.

Within 30 days after
the end of each month, the director shall deposit in the state
treasury the net proceeds of the lottery, which is the balance
in the lottery fund after transfers to the lottery prize fund
and credits to the lottery operations account. Of the net
proceeds, 40 percent must be credited to the Minnesota
environment and natural resources trust fundnew text begin , ... percent must

and recreation fund is established in the state treasury. The
fund consists of money deposited under section 349A.10,
subdivision 5, and interest earned thereon.

new text begin On July 15 of each year, the
director shall certify to the commissioner of finance the amount
of gross revenue from the sale of lottery tickets in each county
in the previous fiscal year. The commissioner of finance shall
distribute money in the county natural resources and recreation
fund to the treasurer of each county in proportion to that
county's percentage of gross lottery ticket revenues for the
previous fiscal year.

the natural resources and recreation fund to a county may only
be expended by that county for natural resources projects,
county parks, and other outdoor recreational activities or
facilities maintained or operated by the county.
