  1.1                          A bill for an act 
  1.2             relating to employment; providing immunity for certain 
  1.3             employment-related disclosures by trucking firms; 
  1.4             proposing coding for new law in Minnesota Statutes, 
  1.5             chapter 181. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [181.98] [REFERENCE CHECKS; TRUCKING FIRMS.] 
  1.8      Subdivision 1.  [IMMUNITY FOR TRUCKING FIRMS.] (a) An 
  1.9   employer, designated employee, or agent of a firm that employs 
  1.10  truck drivers who discloses job-related information, as 
  1.11  described in paragraph (b), regarding a former or current truck 
  1.12  driver to a prospective employer of the driver shall be 
  1.13  absolutely immune from civil liability for the disclosure. 
  1.14     (b) Immunity shall apply to the disclosure of the following 
  1.15  information: 
  1.16     (1) dates of employment; 
  1.17     (2) pay level and wage history; 
  1.18     (3) job description and duties; 
  1.19     (4) written employee evaluations which were conducted prior 
  1.20  to the driver's separation from the employer; 
  1.21     (5) reasons for the driver's separation from service; and 
  1.22     (6) whether the separation was voluntary or involuntary. 
  1.23     Subd. 2.  [EXCEPTION.] Immunity granted under this section 
  1.24  does not preclude a claim arising under chapter 363. 
  1.25     Subd. 3.  [APPLICABILITY.] This section applies to causes 
  2.1   of action arising on or after August 1, 2001.
