A bill for an act
relating to education; redefining student achievement through learning redesign;
appropriating money; amending Minnesota Statutes 2012, section 123B.04;
proposing coding for new law in Minnesota Statutes, chapter 123B.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin [123B.0399] PURPOSE; SCHOOLS REDESIGNING LEARNING.

new text begin To develop the range of knowledge and skills that will permit the young people of
Minnesota to succeed in an increasingly complex and competitive world, the legislature
seeks to encourage districts to test alternatives to the givens of traditional school. The
legislature hopes to empower and encourage districts to authorize "Learning Redesign
Schools" in which students will master not only core academic and career content but will
excel also in other academic areas and will develop the skills needed to think critically and
solve complex problems, to work collaboratively, to communicate effectively, and to learn
continuously. The legislature will require that Learning Redesign Schools demonstrate
their success through multiple, meaningful measures of secondary and postsecondary
accountability. The legislature wishes to spread, and will encourage districts to spread,
such new models of school and approaches to learning where these prove successful, in
the district in which they first appear and beyond.

Minnesota Statutes 2012, section 123B.04, is amended to read:

Subdivision 1.

redesign site may seek an agreement with its school board to redesign learning and
redefine student achievement under this section.

Subd. 1a.

students in poverty, among other students,

students in addition to the state academic standards applicable to all students;

(2) coordinate the pace of deleted text begin instruction anddeleted text end learning with the needs and aptitudes of
individual students at a deleted text begin schooldeleted text end new text begin learning redesignnew text end site;

(3) provide useful data and assist with research in developing and improving
innovative, cost-effective, research-based individualized learning, instruction, and
assessment under this section and section 124D.10;

(4) demonstrate and help evaluate instructional alternatives to age-based grade
progressionnew text begin , including applied and project-based learning and adult basic education,
among other alternatives

(5) more effectively motivate students and teachersnew text begin by expanding teachers' roles and
responsibilities, among other possibilities
new text end ; and

(6) expand use of learning technology to support individualized learning, instruction,
assessment, and achievement.

Subd. 2.

Agreement.

(a) The school board and a deleted text begin schooldeleted text end new text begin learning redesignnew text end site
may enter into an agreement under this section deleted text begin solelydeleted text end to develop and implement an
individualized learning and achievement contract under subdivision 4.

(b) Upon the request of deleted text begin 60 percent ofdeleted text end the new text begin school board or new text end licensed employees deleted text begin ofdeleted text end new text begin atnew text end a
new text begin learning redesign new text end site deleted text begin or a school site decision-making teamdeleted text end , the school board deleted text begin shalldeleted text end new text begin and a
learning redesign site team may
new text end enter into deleted text begin discussions to reachdeleted text end an agreement concerning
deleted text begin thedeleted text end governance, management, new text begin education accountability, new text end or control deleted text begin ofdeleted text end new text begin atnew text end the deleted text begin schooldeleted text end new text begin learning
redesign site
new text end . A deleted text begin school site decision-making team may include thedeleted text end school principal,
teachers in the school or their designee, other employees in the school, representatives
new text begin and parents new text end of pupils in the school, deleted text begin ordeleted text end new text begin andnew text end other members in the communitynew text begin at a learning
redesign site are eligible to participate in this process as learning redesign site team
members
new text end . deleted text begin A school site decision-makingdeleted text end new text begin Thenew text end team must include at least one parent of a
pupil in the schooldeleted text begin . For purposes of formation of a new site, a school site decision-making
team may be a team of
deleted text end new text begin ,new text end teachers deleted text begin that is recognized by the board as a site. The school
site decision-making team shall include
deleted text end new text begin who must be a majority of the team members,
new text end the school principal deleted text begin ordeleted text end new text begin , and, where applicable, thenew text end other person deleted text begin having generaldeleted text end new text begin most
directly responsible for
new text end control and supervision of the deleted text begin school. The site decision-making

district, unless an employee is the parent of a student enrolled in the school site, in which
case the employee may elect to serve as a parent member of the site team.

(d) An agreement shall include a statement of powers, duties, responsibilities, and
authority to be delegated to and within the new text begin learning redesign new text end site.

(e) An agreement may include:

(1) an achievement contract according to subdivision 4;

(2) new text begin where applicable, new text end a mechanism to allow principalsdeleted text begin ,deleted text end new text begin ornew text end a new text begin learning redesign new text end site
deleted text begin leadershipdeleted text end teamdeleted text begin , or other persons having general control and supervision of the school,deleted text end to
make decisions deleted text begin regardingdeleted text end new text begin aboutnew text end how financial and personnel resources are best allocated
at the new text begin learning redesign new text end site and from whom goods or services are purchased;

(3) a mechanism to implement parental involvement programs under section
124D.895 and to provide for effective parental communication deleted text begin and feedbackdeleted text end on this
involvement at the new text begin learning redesign new text end site level;

(4) a provision that would allow the team to deleted text begin determinedeleted text end new text begin advise the school board about
new text end who is hired into licensed and nonlicensed positionsnew text begin at the learning redesign sitenew text end ;

(5) new text begin where applicable, new text end a provision that would allow teachers to choose the principal
or other person having general controlnew text begin at the learning redesign sitenew text end ;

(6) deleted text begin an amount ofdeleted text end new text begin anynew text end revenue allocated to the new text begin learning redesign new text end site under
subdivision 3; and

(7) any other powers and duties determined appropriate by the boardnew text begin and the
learning redesign site team

The school board of the district remains the legal employer under clauses (4) and (5).

(f) Any powers or duties not delegated to the deleted text begin schooldeleted text end new text begin learning redesignnew text end site
deleted text begin managementdeleted text end team in the deleted text begin school site managementdeleted text end new text begin learning redesign sitenew text end agreement shall
remain with the school board.

(g) Approved agreements shall be filed with the commissioner. If a deleted text begin school board
denies a request or the school
deleted text end new text begin learning redesignnew text end site and school board fail to reach an
agreement deleted text begin to enter into a school site management agreementdeleted text end , the school board new text begin and the
learning redesign site team
new text end shall new text begin each new text end provide deleted text begin a copy of the request anddeleted text end the reasons for deleted text begin its
denial

allow new text begin learning redesign new text end sites to implement an agreement that at least:

(1) notwithstanding subdivision 3, allocates to the new text begin learning redesign new text end site deleted text begin alldeleted text end new text begin a grant
award or
new text end revenue deleted text begin that isdeleted text end attributable to the students at that site;

(2) includes a provision, consistent with current law and the collective bargaining
agreement in effect, that allows the new text begin learning redesign new text end site team to deleted text begin decidedeleted text end new text begin advise the school
board about
new text end who is selected from within the district for licensed and nonlicensed positions
at the new text begin learning redesign new text end site and to deleted text begin makedeleted text end new text begin advise about faculty andnew text end staff assignments deleted text begin in
deleted text end new text begin atnew text end the new text begin learning redesign new text end site; and

(3) includes a completed performance agreement under subdivision 4.

new text begin (b) Consistent with subdivision 5, new text end the commissioner shall establish the form and
manner of the application for a grant and annually, at the end of each fiscal year, report to
the house of representatives and senate committees having jurisdiction over education
on the progress of the program.

Subd. 3.

Revenue and cost allocation.

new text begin Where applicable, new text end revenue for a fiscal year
received or receivable by the district shall be allocated to deleted text begin educationdeleted text end new text begin learning redesign
new text end sites based on the agreement between the school board and the new text begin learning redesign new text end site
deleted text begin decision-makingdeleted text end team. Revenue shall remain allocated to deleted text begin eachdeleted text end new text begin the learning redesign
new text end site until used by the site. The site teams and the board may enter an agreement that
permits the district to provide services and retain the revenue required to pay for the
services provided. The district remains responsible for legally entering into contracts
and expending funds. For the purposes of this subdivision, "allocation" means that the
determination of the use of the revenue shall be under the control of the site. The district

actual costs of goods and services from the general or capital funds attributable to the site.

Subd. 4.

Achievement contract.

A school board may enter a written
deleted text begin educationdeleted text end new text begin learning redesignnew text end site achievement contract with each new text begin learning redesign new text end site
deleted text begin decision-makingdeleted text end team for:

(1) setting individualized learning and achievement measures and short- and
long-term educational goals for each student at that site;

(2) recognizing each student's educational needs and aptitudes and levels of
academic attainment, whether on grade level or above or below grade level, so as to
improve student performance through such means as a cost-effective, research-based
formative assessment system designed to promote individualized learning and assessment;

(3) using student performance data to diagnose a student's academic strengths and
weaknesses and indicate to the student's teachers the specific skills and concepts that
need to be introduced to the student and developed through academic instruction or
applied learning, organized by strands within subject areas and linked to state and local
academic standards during the next year, consistent with the student's short- and long-term
educational goals; deleted text begin anddeleted text end

(4) assisting the deleted text begin educationdeleted text end new text begin learning redesignnew text end site if progress in achieving student or
contract goals or other performance expectations or measures agreed to by the board and
the new text begin learning redesign new text end site deleted text begin decision-makingdeleted text end team are not realized or implementednew text begin ; and
new text end

new text begin (5) defining broader objectives to be used by the site and the measures used to assess
the site's achievement of those objectives
new text end .

Subd. 4a.

Additional site agreements premised on successful achievement
contracts.

A school board that enters into a written education achievement contract
with a deleted text begin schooldeleted text end new text begin learning redesignnew text end site under subdivision 4 where the student performance
data at the site demonstrate at least three consecutive school years of improved student
achievement consistent with the terms of the achievement contract deleted text begin maydeleted text end new text begin mustnew text end seek to
establish a similar achievement contract deleted text begin withdeleted text end new text begin atnew text end other deleted text begin school sites in thedeleted text end districtnew text begin sitesnew text end .

Subd. 5.

Commissioner's rolenew text begin ; grant awards and evaluationnew text end .

new text begin (a) The
commissioner must encourage districts to enter into a learning redesign site agreement
under this section and may award grants to applicants that have entered into such
an agreement. Grant amounts may not exceed $....... per resident pupil unit in the
learning redesign site in the prior school year. The commissioner shall award grants on
a first-come-first-served basis to eligible applicants the commissioner determines have
met grant program requirements.

with agreements under this section;

Sec. 3. new text begin APPROPRIATIONS; LEARNING REDESIGN SITE GRANTS.

new text begin $....... in fiscal year 2014 and $....... in fiscal year 2015 are appropriated from the
general fund to the commissioner of education for learning redesign site grants under
Minnesota Statutes, section 123B.04. Any unexpended funds in the first year do not
cancel but are available in the second year.
