  1.1                          A bill for an act 
  1.2             relating to crime; requiring individuals convicted of 
  1.3             certain predatory crimes to provide a biological 
  1.4             specimen for DNA analysis; amending Minnesota Statutes 
  1.5             1998, section 609.3461, subdivisions 1 and 2. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 609.3461, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [UPON SENTENCING.] The court shall order an 
  1.10  offender to provide a biological specimen for the purpose of DNA 
  1.11  analysis as defined in section 299C.155 when: 
  1.12     (1) the court sentences a person charged with violating or 
  1.13  attempting to violate section 609.185, clause (2), 609.342, 
  1.14  609.343, 609.344, 609.345, or 617.23, subdivision 3, clause (2), 
  1.15  who is convicted of violating one of those sections any of the 
  1.16  following, and the person is convicted of that offense or of any 
  1.17  offense arising out of the same set of circumstances;: 
  1.18     (i) murder under section 609.185, 609.19, or 609.195; 
  1.19     (ii) manslaughter under section 609.20 or 609.205; 
  1.20     (iii) assault under section 609.221, 609.222, or 609.223; 
  1.21     (iv) robbery under section 609.24 or aggravated robbery 
  1.22  under section 609.245; 
  1.23     (v) kidnapping under section 609.25; 
  1.24     (vi) false imprisonment under section 609.255; 
  1.25     (vii) criminal sexual conduct under section 609.342, 
  2.1   609.343, 609.344, or 609.345; 
  2.2      (viii) incest under section 609.365; 
  2.3      (ix) burglary under section 609.582, subdivision 1; or 
  2.4      (x) indecent exposure under section 617.23, subdivision 3, 
  2.5   clause (2); 
  2.6      (2) the court sentences a person as a patterned sex 
  2.7   offender under section 609.108; or 
  2.8      (3) the juvenile court adjudicates a person a delinquent 
  2.9   child who is the subject of a delinquency petition for violating 
  2.10  or attempting to violate section 609.185, clause (2), 609.342, 
  2.11  609.343, 609.344, 609.345, or 617.23, subdivision 3, clause (2) 
  2.12  any of the following, and the delinquency adjudication is based 
  2.13  on a violation of one of those sections or of any offense 
  2.14  arising out of the same set of circumstances: 
  2.15     (i) murder under section 609.185, 609.19, or 609.195; 
  2.16     (ii) manslaughter under section 609.20 or 609.205; 
  2.17     (iii) assault under section 609.221, 609.222, or 609.223; 
  2.18     (iv) robbery under section 609.24 or aggravated robbery 
  2.19  under section 609.245; 
  2.20     (v) kidnapping under section 609.25; 
  2.21     (vi) false imprisonment under section 609.255; 
  2.22     (vii) criminal sexual conduct under section 609.342, 
  2.23  609.343, 609.344, or 609.345; 
  2.24     (viii) incest under section 609.365; 
  2.25     (ix) burglary under section 609.582, subdivision 1; or 
  2.26     (x) indecent exposure under section 617.23, subdivision 3, 
  2.27  clause (2). 
  2.28  The biological specimen or the results of the analysis shall be 
  2.29  maintained by the bureau of criminal apprehension as provided in 
  2.30  section 299C.155. 
  2.31     Sec. 2.  Minnesota Statutes 1998, section 609.3461, 
  2.32  subdivision 2, is amended to read: 
  2.33     Subd. 2.  [BEFORE RELEASE.] If a person convicted of 
  2.34  violating or attempting to violate section 609.185, clause (2), 
  2.35  609.342, 609.343, 609.344, 609.345, or 617.23, subdivision 3, 
  2.36  clause (2), or initially charged with violating one of those 
  3.1   sections and convicted of another offense arising out of the 
  3.2   same set of circumstances, or sentenced as a patterned sex 
  3.3   offender under section 609.108, and committed to the custody of 
  3.4   the commissioner of corrections, or serving a term of 
  3.5   imprisonment in this state under a reciprocal agreement although 
  3.6   convicted in another state of an offense described in this 
  3.7   subdivision or a similar law of the United States or any other 
  3.8   state, has not provided a biological specimen for the purpose of 
  3.9   DNA analysis, The commissioner of corrections or local 
  3.10  corrections authority shall order the a person to provide a 
  3.11  biological specimen for the purpose of DNA analysis before 
  3.12  completion of the person's term of imprisonment. when the person 
  3.13  has not provided a biological specimen for the purpose of DNA 
  3.14  analysis and the person: 
  3.15     (1) was convicted of violating or attempting to violate any 
  3.16  of the following or initially charged with violating one of the 
  3.17  following sections and convicted of another offense arising out 
  3.18  of the same set of circumstances: 
  3.19     (i) murder under section 609.185, 609.19, or 609.195; 
  3.20     (ii) manslaughter under section 609.20 or 609.205; 
  3.21     (iii) assault under section 609.221, 609.222, or 609.223; 
  3.22     (iv) robbery under section 609.24 or aggravated robbery 
  3.23  under section 609.245; 
  3.24     (v) kidnapping under section 609.25; 
  3.25     (vi) false imprisonment under section 609.255; 
  3.26     (vii) criminal sexual conduct under section 609.342, 
  3.27  609.343, 609.344, or 609.345; 
  3.28     (viii) incest under section 609.365; 
  3.29     (ix) burglary under section 609.582, subdivision 1; or 
  3.30     (x) indecent exposure under section 617.23, subdivision 3, 
  3.31  clause (2); 
  3.32     (2) was sentenced as a patterned sex offender under section 
  3.33  609.108, and committed to the custody of the commissioner of 
  3.34  corrections; or 
  3.35     (3) is serving a term of imprisonment in this state under a 
  3.36  reciprocal agreement although convicted in another state of an 
  4.1   offense described in this subdivision or a similar law of the 
  4.2   United States or any other state.  The commissioner of 
  4.3   corrections or local corrections authority shall forward the 
  4.4   sample to the bureau of criminal apprehension. 
  4.5      Sec. 3.  [INSTRUCTION TO REVISOR.] 
  4.6      The revisor of statutes shall renumber Minnesota Statutes 
  4.7   1998, section 609.3461, as section 609.117. 
  4.8      Sec. 4.  [EFFECTIVE DATE.] 
  4.9      Sections 1 to 3 are effective July 1, 2000, and apply to 
  4.10  offenders sentenced or released on or after that date.
