  1.1                          A bill for an act 
  1.2             relating to municipal electric power; defining city 
  1.3             within the meaning of the act; authorizing the 
  1.4             Minneapolis park and recreation board to engage in the 
  1.5             local distribution and sale of hydroelectric power to 
  1.6             protect the natural, historical, ecological, and 
  1.7             aesthetic value of the Mississippi river at the Falls 
  1.8             of St. Anthony; amending Minnesota Statutes 1998, 
  1.9             section 453.52, subdivision 3. 
  1.10  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.11     Section 1.  Minnesota Statutes 1998, section 453.52, 
  1.12  subdivision 3, is amended to read: 
  1.13     Subd. 3.  [CITY.] "City" means a city organized and 
  1.14  existing under the laws of Minnesota or a city charter adopted 
  1.15  pursuant thereto, and authorized by such laws or charter to 
  1.16  engage in the local distribution and sale of electric energy; 
  1.17  provided that any city so engaged on January 1, 1976, is 
  1.18  authorized to continue such distribution and sale, and every 
  1.19  city now or hereafter so authorized may exercise, either 
  1.20  individually or as a member of a municipal power agency, all of 
  1.21  the powers granted in sections 453.51 to 453.62.  "City" also 
  1.22  includes a city organized and existing under the laws of another 
  1.23  state or a city charter adopted pursuant thereto which 
  1.24  participates in a municipal power agency with Minnesota cities 
  1.25  and pays a full pro rata share of the expenses of the agency.  
  1.26     "City" also includes a park and recreation board in a city 
  1.27  of the first class. 
  2.1      Sec. 2.  [AUTHORITY OF THE MINNEAPOLIS PARK AND RECREATION 
  2.2   BOARD.] 
  2.3      The Minneapolis park and recreation board may engage in the 
  2.4   local distribution and sale of electric energy solely for a 
  2.5   hydroelectric generating facility of less than two megawatts to 
  2.6   ensure the natural, historical, ecological, and aesthetic value 
  2.7   of the Mississippi river at the Falls of St. Anthony. 
  2.8      Sec. 3.  [EFFECTIVE DATE.] 
  2.9      Section 1 takes effect the day after final enactment.  
  2.10  Section 2 is effective the day after the certificate of approval 
  2.11  of the Minneapolis park and recreation board is filed in 
  2.12  compliance with Minnesota Statutes, section 645.021, subdivision 
  2.13  3.
