A bill for an act
relating to environment; modifying disposition of certain money recovered by
the state; amending Minnesota Statutes 2010, section 115.073.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2010, section 115.073, is amended to read:

115.073 ENFORCEMENT FUNDING.

new text begin (a) new text end Except as provided in new text begin paragraph (b) and new text end section 115C.05, all money recovered by
the state under this chapter and chapters 115A and 116, including civil penalties and money
paid under an agreement, stipulation, or settlement, excluding money paid for past due fees
or taxes, must be deposited in the state treasury and credited to the environmental fund.

new text begin (b) All money recovered by the state under this chapter and chapters 115A and 116
from an ethanol plant, as defined under section 41A.09, or a cellulosic biofuel facility,
as defined under section 41A.10, including civil penalties and money paid under an
agreement, stipulation, or settlement, must be deposited in the state treasury and credited
to the general fund.
