  1.1                          A bill for an act
  1.2             relating to human services; requiring the commissioner 
  1.3             of human services to implement a pharmaceutical care 
  1.4             demonstration project; amending Minnesota Statutes 
  1.5             2002, section 256B.0625, by adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 256B.0625, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 13c.  [PHARMACEUTICAL CARE DEMONSTRATION PROJECT.] (a)
  1.10  The commissioner of human services shall seek federal approval 
  1.11  to implement a medical assistance demonstration project to 
  1.12  provide culturally specific pharmaceutical care to American 
  1.13  Indian recipients who are age 55 and older.  In developing the 
  1.14  demonstration project, the commissioner shall consult with 
  1.15  organizations and health care providers experienced in 
  1.16  developing and implementing culturally competent intervention 
  1.17  strategies to manage the use of prescription drugs, 
  1.18  over-the-counter drugs, other drug products, and native 
  1.19  therapies by American Indian elders. 
  1.20     (b) For purposes of this subdivision, "pharmaceutical care" 
  1.21  means the responsible provision of drug therapy and native 
  1.22  therapy for the purpose of improving a patient's quality of life 
  1.23  by:  (1) curing a disease; (2) eliminating or reducing a 
  1.24  patient's symptoms; (3) arresting or slowing a disease process; 
  1.25  or (4) preventing a disease or a symptom.  Pharmaceutical care 
  2.1   involves the documented process through which a pharmacist 
  2.2   cooperates with a patient and other professionals in designing, 
  2.3   implementing, and monitoring a therapeutic plan that is expected 
  2.4   to produce specific therapeutic outcomes, through the 
  2.5   identification, resolution, and prevention of drug-related 
  2.6   problems. 
  2.7      [EFFECTIVE DATE.] This section is effective July 1, 2003, 
  2.8   or upon federal approval, whichever is later.
