  1.1                          A bill for an act 
  1.2             relating to counties; providing for an appeal to the 
  1.3             county board from a decision of the board of 
  1.4             adjustments and appeals; amending Minnesota Statutes 
  1.5             2002, section 394.27, subdivision 9. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 394.27, 
  1.8   subdivision 9, is amended to read: 
  1.9      Subd. 9.  [APPEAL TO COUNTY BOARD; DISTRICT COURT.] All 
  1.10  decisions by the board of adjustment in granting variances or in 
  1.11  hearing appeals from any administrative order, requirement, 
  1.12  decision or determination shall be are final except that any 
  1.13  aggrieved person or persons, or any department, board or 
  1.14  commission of the jurisdiction or of the state shall have the 
  1.15  right to may appeal within 30 days, after receipt of notice of 
  1.16  the decision, to the county board or directly to the district 
  1.17  court in the county in which the land is located on questions of 
  1.18  law and fact.  The county board may by resolution affirm, 
  1.19  reverse, or modify the board of adjustment's decision.  The 
  1.20  county board must provide findings of fact to support its 
  1.21  resolution.  An appeal from the decision of the county board to 
  1.22  the district court may be brought within 30 days of the decision.
