  1.1                          A bill for an act 
  1.2             relating to higher education; changing requirements 
  1.3             for the state grant program; amending Minnesota 
  1.4             Statutes 2002, section 136A.121, subdivisions 3, 6; 
  1.5             repealing Minnesota Statutes 2002, section 136A.121, 
  1.6             subdivision 9a.  
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2002, section 136A.121, 
  1.9   subdivision 3, is amended to read: 
  1.10     Subd. 3.  [ALLOCATION.] Grants must be awarded on a funds 
  1.11  available basis to those applicants who meet the office's 
  1.12  requirements.  Grants must not be awarded for summer academic 
  1.13  terms.  
  1.14     Sec. 2.  Minnesota Statutes 2002, section 136A.121, 
  1.15  subdivision 6, is amended to read: 
  1.16     Subd. 6.  [COST OF ATTENDANCE.] (a) The recognized cost of 
  1.17  attendance consists of allowances specified in law for living 
  1.18  and miscellaneous expenses, and an allowance for tuition and 
  1.19  fees equal to the lesser of the actual tuition and fees charged 
  1.20  by the institution, or the private institution tuition and fee 
  1.21  maximums established in law. 
  1.22     (b) For the purpose of paragraph (a), the private 
  1.23  institution tuition and fee maximum for two- and four-year, 
  1.24  private, residential, liberal arts, degree-granting colleges and 
  1.25  universities must be the same. 
  1.26     (c) For a student registering for less than full time, the 
  2.1   office shall prorate the living and miscellaneous expense 
  2.2   allowance to the actual number of credits for which the student 
  2.3   is enrolled. 
  2.4      The recognized cost of attendance for a student who is 
  2.5   confined to a Minnesota correctional institution shall consist 
  2.6   of the tuition and fee component in paragraph (a), with no 
  2.7   allowance for living and miscellaneous expenses. 
  2.8      Sec. 3.  [REPEALER.] 
  2.9      Minnesota Statutes 2002, section 136A.121, subdivision 9a, 
  2.10  is repealed.
