  1.1                          A bill for an act 
  1.2             relating to education; continuing a library project; 
  1.3             appropriating money; amending Laws 1997, First Special 
  1.4             Session chapter 4, article 8, section 4. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Laws 1997, First Special Session chapter 4, 
  1.7   article 8, section 4, is amended to read: 
  1.8      Sec. 4.  [LIBRARY PILOT PROJECT.] 
  1.9      Subdivision 1.  [ESTABLISHMENT.] Notwithstanding law to the 
  1.10  contrary and subject to approvals in subdivision 2, a public 
  1.11  library may operate as a pilot library project jointly with the 
  1.12  school library at Nashwauk-Keewatin high school, located in the 
  1.13  city of Nashwauk.  The public library is established to serve 
  1.14  persons within the boundaries of independent school district No. 
  1.15  319, except the city of Keewatin. 
  1.16     Subd. 2.  [APPROVALS.] Operation of the public library is 
  1.17  contingent upon a resolution approved by the governing bodies of 
  1.18  cities, towns, and unorganized townships within the geographical 
  1.19  boundaries of independent school district No. 319, except for 
  1.20  the city of Keewatin, entering into a joint powers agreement 
  1.21  under Minnesota Statutes 1998, section 471.59, to accomplish the 
  1.22  purpose of this section.  The joint powers agreement must 
  1.23  provide for continuing the library project if one party to the 
  1.24  agreement withdraws from the agreement.  For the purposes of 
  1.25  this subdivision, the Itasca county board is designated as the 
  2.1   governing body for the unorganized townships. 
  2.2      Subd. 3.  [BOARD; APPOINTMENTS.] The resolution joint 
  2.3   powers agreement in subdivision 2 shall provide for a library 
  2.4   board of five members as follows:  two members appointed by the 
  2.5   school board of independent school district No. 319, one member 
  2.6   appointed by each town board located within independent school 
  2.7   district No. 319 boundaries, one member appointed by the council 
  2.8   of the city of Nashwauk, and one member appointed by the Itasca 
  2.9   county board to represent the unorganized towns within the 
  2.10  school district territory. 
  2.11     Subd. 4.  [BOARD TERMS; COMPENSATION.] The library board 
  2.12  members shall serve for the term of the pilot program library 
  2.13  project.  An appointing authority may remove for misconduct or 
  2.14  neglect any member it has appointed to the board and may replace 
  2.15  that member by appointment.  Board members shall receive no 
  2.16  compensation for their services but may be reimbursed for actual 
  2.17  and necessary travel expenses incurred in the discharge of 
  2.18  library board duties and activities. 
  2.19     Subd. 5.  [FUNDING.] For taxes payable in 1998 2000 and 
  2.20  1999 2001 only, the library board may levy a tax in an amount up 
  2.21  to $25,000 annually on property located within the boundaries of 
  2.22  independent school district No. 319, except the city of 
  2.23  Keewatin.  The Itasca county auditor shall collect the tax and 
  2.24  distribute it to the library board.  The money may be used for 
  2.25  library staff and for the purchase of library materials, 
  2.26  including computer software.  The levy must also fund the amount 
  2.27  necessary to receive bookmobile services from the Arrowhead 
  2.28  regional library system.  For taxes payable in 1998 2000 and 
  2.29  1999 2001 only, the county may not levy under Minnesota 
  2.30  Statutes, section 134.07, for the areas described in this 
  2.31  section. 
  2.32     Subd. 6.  [BUILDING.] The school district shall provide the 
  2.33  physical space and costs associated with operating the library 
  2.34  including, but not limited to, heat, light, telephone service, 
  2.35  and maintenance. 
  2.36     Subd. 7.  [ORGANIZATION.] Immediately after appointment, 
  3.1   the library board shall organize by electing one of its number 
  3.2   as president and one as secretary, and it may appoint other 
  3.3   officers it finds necessary. 
  3.4      Subd. 8.  [DUTIES.] The library board shall adopt bylaws 
  3.5   and regulations for the library and for the conduct of its 
  3.6   business as may be expedient and conformable to law.  It shall 
  3.7   have exclusive control of the expenditure of all money collected 
  3.8   for it.  The library board shall appoint a qualified library 
  3.9   director and other staff, establish the compensation of 
  3.10  employees, and remove any of them for cause.  The library board 
  3.11  may contract with the school board, the regional library board, 
  3.12  or the city in which the library is located to provide 
  3.13  personnel, fiscal, or administrative services.  The contract 
  3.14  shall state the personnel, fiscal, and administrative services 
  3.15  and payments to be provided by each party. 
  3.16     Subd. 9.  [CRITERIA.] The library shall meet all 
  3.17  requirements in statutes and rules applicable to public 
  3.18  libraries and school media centers.  A media supervisor licensed 
  3.19  by the board of teaching may be the director of the library.  
  3.20  Public parking, restrooms, drinking water, and other necessities 
  3.21  shall be easily accessible to library patrons. 
  3.22     Subd. 10.  [REPORT.] The library board shall report to the 
  3.23  department of children, families, and learning by February 1, 
  3.24  1999, about the costs of providing the library service and the 
  3.25  number of patrons served. 
  3.26     Subd. 11.  [EXPIRATION.] This section expires January 31, 
  3.27  2000.
