  1.1                          A bill for an act 
  1.2             relating to drivers' licenses; restricting discretion 
  1.3             of commissioner of public safety to take action 
  1.4             against a driver for violation of condition of 
  1.5             abstinence; amending Minnesota Statutes 2000, section 
  1.6             171.29, by adding a subdivision. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2000, section 171.29, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 4.  [REINSTATEMENT ON CONDITION OF ABSTINENCE.] When 
  1.11  the commissioner has reinstated a driver's license after 
  1.12  revocation or suspension wholly or partly on the condition that 
  1.13  the licensee abstain completely from the consumption of alcohol, 
  1.14  the commissioner may not take any action against the licensee 
  1.15  for a violation of that condition based solely on the licensee's 
  1.16  consumption of a beverage that does not meet the definition of 
  1.17  "alcoholic beverage" in section 340A.101, subdivision 2.
