A bill for an act
relating to energy; establishing setbacks for certain solar energy generating systems;
amending Minnesota Statutes 2020, section 216E.01, subdivision 5; proposing
coding for new law in Minnesota Statutes, chapter 216E.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2020, section 216E.01, subdivision 5, is amended to read:


Subd. 5.

Large electric power generating plant.

"Large electric power generating

Sec. 2.

new text begin [216E.022] SETBACKS; SOLAR ENERGY GENERATING SYSTEMS.

new text begin A permit must not be granted under this chapter to construct a solar energy generating
system located within:
new text end

new text begin (1) 250 feet of a public road right-of-way;
new text end

new text begin (2) 500 feet of a state trail or other recreational trail;
new text end

new text begin (3) three-quarters of a mile of a state park or county park; or
new text end

new text begin (4) three-quarters of a mile of a wildlife management area.

new text begin This section is effective the day following final enactment and
applies to all solar energy generating systems commencing construction on or after that
date.
