  1.1                          A bill for an act 
  1.2             relating to alcoholic beverages; providing for 
  1.3             termination of agreements between brewer and 
  1.4             wholesaler under certain circumstances; proposing 
  1.5             coding for new law in Minnesota Statutes, chapter 325B.
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [325B.075] [TERMINATIONS AUTHORIZED.] 
  1.8      A brewer may terminate an agreement with a wholesaler 
  1.9   without complying with sections 325B.04 to 325B.07 if in the 
  1.10  calendar year preceding the year in which the termination is 
  1.11  effective:  (1) the brewer manufactured not more than 25,000 
  1.12  barrels of beer; and (2) sales of the brewer's beer, as measured 
  1.13  by volume, were not more than five percent of the wholesaler's 
  1.14  total sales of beer.  A brewer intending to terminate an 
  1.15  agreement under this section must provide the wholesaler with 
  1.16  written notice of the termination at least 30 days before the 
  1.17  effective date of the termination.
