A bill for an act
relating to body art; imposing penalties for performing body art or operating
a body art establishment without a license; proposing coding for new law in
Minnesota Statutes, chapter 146B.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin (a) Except as provided in section 146B.03, subdivision 3, a person who performs
body art without a valid technician license issued by the commissioner under this chapter
shall be guilty of a gross misdemeanor.

new text begin (b) Except as permitted under section 146B.02, subdivision 8 or 9, if a person acting
individually or jointly with any other person maintains, owns, or operates a body art
establishment in the state without an establishment license issued by the commissioner
under this chapter, the district court on application of the commissioner may issue an
injunction or other appropriate order for the person to cease operation of the establishment.

new text begin (c) The commissioner may impose, for each violation, a civil penalty not exceeding
$10,000 that deprives the person of any economic advantage gained by the violation and
that reimburses the department for costs of the investigation.
