1.1 A bill for an act 1.2 relating to motor vehicles; allowing collector 1.3 vehicles to be used for general transportation 1.4 purposes with payment of registration tax and minimum 1.5 additional tax; making technical and clarifying 1.6 changes; amending Minnesota Statutes 2002, section 1.7 168.10. 1.8 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.9 Section 1. Minnesota Statutes 2002, section 168.10, is 1.10 amended to read: 1.11 168.10 [REGISTRATION; COLLECTOR VEHICLE.] 1.12 Subdivision 1. [APPLICATION.] (a) Except as provided in 1.13 subdivisions 1a, 1b, 1c, 1d, 1g, and 1h, every owner of any 1.14 motor vehicle in this state, not exempted by section 168.012 or 1.15 168.26, shall as soon as registered ownership of a motor vehicle 1.16 is acquired, and annually thereafter during the period provided 1.17 in section 168.31, file with the commissioner of public safety 1.18 on a blank provided by the commissioner a listing for taxation 1.19 and application for the registration ofsuchthe vehicle, 1.20 stating the first, middle, and last names,thedate of birth, 1.21 andtheaddress of the primary residenceof each registered1.22owner thereof who is a natural personormailing address, if the 1.23 address of the primary residence has been classified as private 1.24 data under this chapter, the mailing address of each registered 1.25 owner who is a natural person; the full name and address of any 1.26 other registered owner,; the name and address of the person from 2.1 whom purchased,; the make of motor vehicle, year and number of 2.2 the model, manufacturer's identification number or serial 2.3 number, type of body,theand weight of the vehicle in pounds,; 2.4 for trailers only, its rated load carrying capacity and, for 2.5 buses only, its seating capacity,; andsuchother informationas2.6 the commissioner may require. Any false statement willfully and 2.7 knowingly made in regardthereto shall beto the listing and 2.8 application for registration is deemed perjury and punished 2.9 accordingly. The listing and application for registration by 2.10 dealers or manufacturers' agents within the state, of motor 2.11 vehicles received for sale or use within the stateshall beis 2.12 accepted as compliance with the requirements of this chapter, 2.13 imposed upon the manufacturer. 2.14 (b) Registrationshallmust be refused for a motor vehicle 2.15 if the original identification or serial number has been 2.16 destroyed, removed, altered, covered, or defaced. However, if 2.17 the commissioner is satisfied on the sworn statements ofthe2.18 each registered owneror registered ownersorsuchany other 2.19personsperson as the commissioner may deem advisable that the 2.20 applicant is the legal owner, a special identification number in 2.21 the form prescribed by the commissionershallmust be assigned 2.22 to the motor vehicle. When it has been determined that the 2.23 numberhad beenis affixed tosuchthe vehicle in a manner 2.24 prescribed by the commissioner, the vehicle may thereafter be 2.25 registered in the same manner as other motor vehicles. In the 2.26 case of a new or rebuilt motor vehicle manufactured or assembled 2.27 without an identification or serial number, the commissioner may 2.28 assign an identification number to the motor vehicle in the same 2.29 manner as prescribed heretofore. 2.30 Subd. 1a. [COLLECTOR'S VEHICLE, PIONEER LICENSE.] (a) Any 2.31 motor vehicle manufactured prior to 1936 and owned and operated 2.32solely as a collector's item shallin Minnesota must be listed 2.33 for taxation and registration as follows: The owner shall 2.34 execute an affidavitshall be executedstating the name and 2.35 address of the owner, the name and address of the person from 2.36 whom purchased, the make of the motor vehicle, the year and 3.1 number of the model, the manufacturer's identification number, 3.2 and that the vehicle is owned and operated: 3.3 (1) solely as a collector's item and not for general 3.4 transportation purposes; or 3.5 (2) both as a collector's item and for general 3.6 transportation purposes.If the registrar is satisfied that the3.7affidavit is true and correct and the owner pays a $25 tax,3.8 (b) The registrar shall listsuchthe vehicle for taxation 3.9 and registration and shall issue a single number plate if 3.10 satisfied that the affidavit is true and correct and: 3.11 (1) if the affidavit makes the statement shown in paragraph 3.12 (a), clause (1), the owner pays a $25 tax; or 3.13 (2) if the affidavit makes the statement shown in paragraph 3.14 (a), clause (2), the owner annually pays the $10 registration 3.15 tax under section 168.013, subdivision 1a, paragraph (a), plus 3.16 the minimum additional tax under section 168.013, subdivision 3.17 1a, paragraph (h). 3.18(b)(c) The number plateso issued shallmust bear the 3.19 inscription "Pioneer," "Minnesota" and the registration number 3.20 or other combination of characters authorized under section 3.21 168.12, subdivision 2a, but no date. 3.22 (d) The number plate is valid without renewal as long as 3.23 the vehicle is in existence and the vehicle's owner continues to 3.24 comply with this subdivision. The registrarhas the power to3.25 may revokesaidthe plate for failure to comply with this 3.26 subdivision. 3.27 Subd. 1b. [COLLECTOR'S VEHICLE, CLASSIC CAR LICENSE.] (a) 3.28 Any motor vehicle manufactured between and including the years 3.29 1925 and 1948, and designated by the registrar of motor vehicles 3.30 as a classic car because of its fine design, high engineering 3.31 standards, and superior workmanship, and owned and operated 3.32solely as a collector's item shallin Minnesota must be listed 3.33 for taxation and registration as follows: The owner shall 3.34 execute an affidavitshall be executedstating the name and 3.35 address of the owner, the name and address of the person from 3.36 whom purchased, the make of the motor vehicle, the year and 4.1 number of the model, the manufacturer's identification number, 4.2 and that the vehicle is owned and operated: 4.3 (1) solely as a collector's item and not for general 4.4 transportation purposes; or 4.5 (2) both as a collector's item and for general 4.6 transportation purposes.If the registrar is satisfied that the4.7affidavit is true and correct and that the motor vehicle4.8qualifies to be classified as a classic car, and the owner pays4.9a $25 tax,4.10 (b) The registrar shall listsuchthe vehicle for taxation 4.11 and registration and shall issue a single number plate if 4.12 satisfied that the affidavit is true and correct and: 4.13 (1) if the affidavit makes the statement shown in paragraph 4.14 (a), clause (1), the owner pays a $25 tax; or 4.15 (2) if the affidavit makes the statement shown in paragraph 4.16 (a), clause (2), the owner annually pays the $10 registration 4.17 tax under section 168.013, subdivision 1a, paragraph (a), plus 4.18 the minimum additional tax under section 168.013, subdivision 4.19 1a, paragraph (h). 4.20(b)(c) The number plateso issued shallmust bear the 4.21 inscription "Classic Car," "Minnesota," and the registration 4.22 number or other combination of characters authorized under 4.23 section 168.12, subdivision 2a, but no date. 4.24 (d) The number plate is valid without renewal as long as 4.25 the vehicle is in existence and the vehicle's owner continues to 4.26 comply with this subdivision. [COLLECTOR'S VEHICLE, COLLECTOR LICENSE.] (a) 8.21 The owner of any motor vehicle, including any truck, that is at 8.22 least 20 model years old, was manufactured after 1935, and is 8.23 owned and operatedsolely as a collector's vehiclein Minnesota, 8.24 shall list the vehicle for taxation and registration as follows: 8.25 (1) execute an affidavit stating the name and address of 8.26 the person from whom purchased and of the new owner, the make of 8.27 the motor vehicle, the year and number of the model, the 8.28 manufacturer's identification number, and that the vehicle is 8.29 owned and operated: 8.30 (i) solely as a collector's item and not for general 8.31 transportation purposes; or 8.32 (ii) both as a collector's item and for general 8.33 transportation purposes; and 8.34 (2) prove that the owner also has one or more vehicles with 8.35 regular license plates. 8.36If the registrar is satisfied that the affidavit is true and9.1correct and the owner pays a $25 tax,9.2 (b) The registrar shall list the vehicle for taxation and 9.3 registration and shall issue a single number plate if satisfied 9.4 that the affidavit is true and correct and: 9.5 (1) if the affidavit makes the statement shown in paragraph 9.6 (a), clause (1)(i), the owner pays a $25 tax; or 9.7 (2) if the affidavit makes the statement shown in paragraph 9.8 (a), clause (1)(ii), the owner annually pays the $10 9.9 registration tax under section 168.013, subdivision 1a, 9.10 paragraph (a), plus the minimum additional tax under section 9.11 168.013, subdivision 1a, paragraph (h). 9.12(b)(c) The number plate issuedshallmust bear the 9.13 inscription "Collector," "Minnesota," and the registration 9.14 number or other combination of characters authorized under 9.15 section 168.12, subdivision 2a, but no date. 9.16 (d) The number plate is valid without renewal as long as 9.17 the vehicle is in existence and the vehicle's owner continues to 9.18 comply with this subdivision. The registrarhas the power9.19tomay revoke the plate for failure to comply with this 9.20 subdivision. 9.21 Subd. 1d. [COLLECTOR'S VEHICLE, STREET ROD LICENSE.] (a) 9.22 Any modernized motor vehicle manufactured prior to the year 1949 9.23 or designed and manufactured to resemble such vehicleshallmust 9.24 be listed for taxation and registration as follows: The owner 9.25 shall execute an affidavitshall be executedstating the name 9.26 and address of the person from whom purchased and of the new 9.27 owner, the make of the motor vehicle, the year and number of the 9.28 model, and the manufacturer's identification number. The 9.29 affidavitshallmust further state that the vehicle is owned and 9.30 operated: 9.31 (1) solely as a street rod and not for general 9.32 transportation purposes; or 9.33 (2) both as a street rod and for general transportation 9.34 purposes. 9.35 The owner must also prove that the owner has one or more 9.36 vehicles with regular license plates.If the registrar is10.1satisfied that the affidavit is true and correct and the owner10.2pays a $25 tax,10.3 (b) The registrar shall listsuchthe vehicle for taxation 10.4 and registration and shall issue a single number plate if 10.5 satisfied that the affidavit is true and correct and: 10.6 (1) if the affidavit makes the statement shown in paragraph 10.7 (a), clause (1), the owner pays a $25 tax; or 10.8 (2) if the affidavit makes the statement shown in paragraph 10.9 (a), clause (2), the owner annually pays the $10 registration 10.10 tax under section 168.013, subdivision 1a, paragraph (a), plus 10.11 the minimum additional tax under section 168.013, subdivision 10.12 1a, paragraph (h). 10.13 (c) The number plate issuedshallmust bear the inscription 10.14 "Street Rod", "Minnesota" and the registration number or other 10.15 combination of characters authorized under section 168.12, 10.16 subdivision 2a, but no date. 10.17 (d) The number plate is valid without renewal as long as 10.18 the vehicle is in existence and the vehicle's owner continues to 10.19 comply with this subdivision. The registrarhas the power10.20tomay revokesuchthe plate for failure to comply with this 10.21 subdivision. 10.22 Subd. 1e. [OUTDOOR STORAGE.] Pioneer, classic, collector 10.23 vehicles, collector military vehicles, or street rods, licensed 10.24 or unlicensed, operable or inoperable, may be stored in 10.25 compliance with local government zoning and ordinances on their 10.26 owners' property, provided that the vehicles and any outdoor 10.27 storage areas they may require are maintained in such a manner 10.28 that they do not constitute a health or environmental hazard and 10.29 are screened from ordinary public view by means of a fence, 10.30 shrubbery, rapidly growing trees or other appropriate means. 10.31 The appropriate local agency or authority may inform an owner of 10.32 the owner's failure to comply with these requirements, and may 10.33 order the vehicles removed from the outdoor storage area if the 10.34 owner fails to comply with these requirements within 20 days 10.35 after the warning. 10.36 Subd. 1f. [EQUIPMENT.] Any pioneer, classic, collector 11.1 vehicle, collector military vehicle, or street rodshallmust 11.2 have all equipment, in operating condition, which was 11.3 specifically required by law as a condition for its first sale 11.4 after manufacture. 11.5 No law requiring any particular equipment or specifying any 11.6 standards to be met by motor vehiclesshallapply to pioneer, 11.7 classic, collector vehicles, collector military vehicles, or 11.8 street rods unless it specifically so states. 11.9 Subd. 1g. [ORIGINAL PLATES.] A vehicle registered pursuant 11.10 to subdivision 1a, 1b, 1c, or 1d may in lieu of being issued 11.11 number plates by the registrar display original Minnesota number 11.12 plates issued in the same year as the model year of the car on 11.13 which they are displayed. The number of the original plates 11.14 must be provided to the registrar. The original plates must be 11.15 in good condition andshallmust be used in pairs, one to be 11.16 displayed in the front of the car and one in the rear, except 11.17 for an original plate issued in 1911, 1944, 1945, or 1946, which 11.18 may be used singly and displayed at the rear of the vehicle. 11.19 Original Minnesota number platesshallmust not be used if the 11.20 number on the original plate is identical to a number on any 11.21 current street rod plate or any other plate in a numbering 11.22 system used by the registrar. Any person currently using plates 11.23 issued pursuant to subdivision 1a, 1b, 1c, or 1d shall return 11.24 those plates to the registrar before substituting original 11.25 plates. The registrar may charge a fee for registering the 11.26 number on original plates. 11.27 Subd. 1h. [COLLECTOR MILITARY VEHICLE.] (a) A motor 11.28 vehicle, including a truck,shallmust be listed and registered 11.29 under this section if it meets the following conditions: 11.30 (1) it is at least 20 years old; 11.31 (2) its first owner following its manufacture was a branch 11.32 of the armed forces of the United States and it presently 11.33 conforms to the vehicle specifications required during the time 11.34 of military ownership, or it has been restored and presently 11.35 conforms to the specifications required by a branch of the armed 11.36 forces for the model year that the restored vehicle could have 12.1 been owned by that branch of the armed forces; and 12.2 (3) it is owned and operated by a nonprofit organization 12.3and operated solely as a collector's vehicle. For purposes of 12.4 this subdivision, "nonprofit organization" means a corporation, 12.5 society, association, foundation, or institution organized and 12.6 operated exclusively for historical or educational purposes, no 12.7 part of the net earnings of which inures to the benefit of a 12.8 private individual. 12.9 (b) The owner of the vehicle shall execute an affidavit 12.10 stating the name and address of the person from whom purchased 12.11 and of the new owner; the make, year, and model number of the 12.12 motor vehicle; the manufacturer's identification number; and the 12.13 collector military vehicle identification number, if any, 12.14 located on the exterior of the vehicle. The affidavit must 12.15 affirm that the vehicle is owned by a nonprofit organization and 12.16 is operated: 12.17 (1) solely as a collector's item and not for general 12.18 transportation purposes; or 12.19 (2) both as a collector's item and for general 12.20 transportation purposes.If the registrar is satisfied that the12.21affidavit is true and correct and the owner pays a $25 tax,12.22 (c) The registrar shall list the vehicle for taxation and 12.23 registration and shall issue number plates if satisfied that the 12.24 affidavit is true and correct and: 12.25 (1) if the affidavit makes the statement shown in paragraph 12.26 (b), clause (1), the owner pays a $25 tax; or 12.27 (2) if the affidavit makes the statement shown in paragraph 12.28 (b), clause (2), the owner annually pays the $10 registration 12.29 tax under section 168.013, subdivision 1a, paragraph (a), plus 12.30 the minimum additional tax under section 168.013, subdivision 12.31 1a, paragraph (h). 12.32 (d) The number platesshallmust bear the inscriptions 12.33 "Collector" and "Minnesota" and the registration number, but no 12.34 date. 12.35 (e) The number plates are valid without renewal as long as 12.36 the vehicle is in existence and the vehicle's owner continues to 13.1 comply with this subdivision. The registrar may revoke the 13.2 plates for failure to comply with this subdivision. 13.3(c)(f) Notwithstanding section 168.09, 168.12, or other 13.4 law to the contrary, the owner of a registered collector 13.5 military vehicle is not required to display registration plates 13.6 on the exterior of the vehicle if the vehicle has an exterior 13.7 number identification that conforms to the identifying system 13.8 for military vehicles in effect when the vehicle was last owned 13.9 by the branch of the armed forces of the United States or in 13.10 effect in the year to which the collector military vehicle has 13.11 been restored. However, the state registration plates must be 13.12 carried in or on the collector military vehicle at all times. 13.13(d)(g) The owner of a registered collector military 13.14 vehicle that is not required to display registration plates 13.15 under paragraph(c)(f) may tow a registered trailer behind it. 13.16 The trailer is not required to display registration plates if 13.17 the trailer: 13.18 (1) does not exceed a gross weight of 15,000 pounds; 13.19 (2) otherwise conforms to registration, licensing, and 13.20 safety laws and specifications; 13.21 (3) conforms to military specifications for appearance and 13.22 identification; 13.23 (4) is intended to represent and does represent a military 13.24 trailer; and 13.25 (5) carries registration plates on or in the trailer or the 13.26 collector military vehicle towing the trailer. 13.27 Subd. 1i. [COLLECTOR PLATE TRANSFER.] Notwithstanding 13.28 section 168.12, subdivision 1, on payment of a transfer fee of 13.29 $5, plates issued under this section may be transferred to 13.30 another vehicle owned or jointly owned by the person to whom the 13.31 special plates were issued or the plate may be assigned to 13.32 another owner. If the vehicle is registered solely as a 13.33 collector's item and not for general transportation purposes, a 13.34 new owner must pay, in addition to the transfer feea new owner13.35must pay, the $25 plate tax or any fee required by section 13.36 168.12, subdivision 2a. The $5 fee must be paid into the state 14.1 treasury and credited to the highway user tax distribution 14.2 fund. License plates issued under this section may not be 14.3 transferred to a vehicle not eligible for the collector's 14.4 vehicle license plates. 14.5 Subd. 2. [NEW BODY; APPLICATION.] Upon the installation of 14.6 a new body or the addition to or change of type of any body in 14.7 or upon any registered motor vehicle, the owner shall file with 14.8 the registrar a new application setting forthsuchthe change, 14.9 together with the payment of any additional tax to which the 14.10 motor vehicleby such, because of the change, has become 14.11 subject, and shall apply for a revision of the registration made. 14.12 Subd. 3. [OFFENSES.] Itshall beis unlawful for any 14.13 person: 14.14 (1) to display or cause to be displayed or to possess any 14.15 canceled, revoked, suspended or fraudulently obtained or stolen 14.16 registration plates; 14.17 (2) to lend the person's registration plates to another or 14.18 knowingly to permit the usethereofof the plates by another; 14.19 (3) to display or represent as the person's own any 14.20 registration plates not issued to that person; provided, 14.21 however, thisshallclause does not apply to any legal change of 14.22 ownership of the motor vehicle to which the plates are attached, 14.23 norshalldoes this clause apply to any transfer of collector 14.24 plates under subdivision 1i; 14.25 (4) to fail or refuse to surrender to the department upon 14.26 its lawful demand any registration plateswhichthat have been 14.27 revoked, canceled, or suspended by proper authority; 14.28 (5) to use a false or fictitious name or address or 14.29 description of the motor vehicle, identification number, or 14.30 serial number in any application for registration of a motor 14.31 vehicle or to knowingly make a false statement or to knowingly 14.32 conceal a material fact or otherwise commit a fraud in anysuch14.33 application for registration; 14.34 (6) to destroy, alter, remove, cover, or deface the 14.35 identification or serial number of any motor vehicle or to 14.36 knowingly operate any motor vehicle the identification or serial 15.1 number of which has been destroyed, altered, removed, covered, 15.2 or defaced without first making application for assignment of a 15.3 special identification number as provided by law. 15.4 Subd. 4. [VIOLATION.] Itshall beis a misdemeanor for any 15.5 person to violate any of the provisions of this chapter unless 15.6suchthe violation is by this chapter or other laws of this 15.7 state declared to be a felony or gross misdemeanor.
