  1.1                          A bill for an act 
  1.2             relating to mental health; clarifying notice 
  1.3             requirements for treatment facilities when releasing 
  1.4             persons held for detoxification; amending Minnesota 
  1.5             Statutes 2002, section 253B.05, by adding a 
  1.6             subdivision. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2002, section 253B.05, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 5.  [DETOXIFICATION.] If a person is intoxicated in 
  1.11  public and held under this section for detoxification, a 
  1.12  treatment facility may release the person without providing 
  1.13  notice under subdivision 3, paragraph (c), as soon as the 
  1.14  treatment facility determines the person is no longer 
  1.15  intoxicated. 
  1.16     Sec. 2.  [EFFECTIVE DATE.] 
  1.17     Section 1 is effective the day following final enactment.
