A bill for an act
relating to insurance; the Minnesota Comprehensive Health Association;
providing an exception for children to the association's six-month preexisting
condition limitation; making a technical update; amending Minnesota Statutes
2010, section 62E.14, subdivision 3, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2010, section 62E.14, subdivision 3, is amended to read:


Subd. 3.

Preexisting conditions.

No person who obtains coverage pursuant to
this section shall be covered for any preexisting condition during the first six months of
coverage under the state plan if the person was diagnosed or treated for that condition
during the 90 days immediately preceding the date the application was received by the
writing carrier, except as provided under subdivisions new text begin 3a, new text end 4, 4a, 4b, 4c, 4d,new text begin 4e, 4f,new text end 5, 6,
and 7 and section 62E.18.

Sec. 2.

Minnesota Statutes 2010, section 62E.14, is amended by adding a subdivision
to read:

new text begin Waiver of preexisting conditions; children under age 18. new text end

resident who is otherwise eligible and is under the age of 18 years as of the date of
application, may enroll in the comprehensive health plan with a waiver of the preexisting
condition limitation contained in subdivision 3.
