1.1A bill for an act
1.2relating to drivers' licenses; creating definition of valid license or valid driver's
1.3license;amending Minnesota Statutes 2006, sections 169.01, by adding a
1.4subdivision; 171.01, by adding a subdivision; 171.02, subdivision 1.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2006, section 169.01, is amended by adding a
1.7subdivision to read:
1.8    Subd. 92. Valid license; valid driver's license. "Valid license," "valid driver's
1.9license," "valid Minnesota driver's license," "valid standard driver's license," or other
1.10similar term, has the meaning given in section 171.01, subdivision 49a.

1.11    Sec. 2. Minnesota Statutes 2006, section 171.01, is amended by adding a subdivision
1.12to read:
1.13    Subd. 49a. Valid license; valid driver's license. "Valid license," "valid driver's
1.14license," "valid Minnesota driver's license," "valid standard driver's license," or other
1.15similar term, means any operator's license, provisional license, temporary license, limited
1.16license, permit, or other license to operate a motor vehicle issued or issuable under the
1.17laws of this state by the commissioner, or by another state or jurisdiction if specified,
1.18that is (1) not expired, suspended, revoked, or canceled, and (2) not disqualified for the
1.19class of vehicle being operated.

1.20    Sec. 3. Minnesota Statutes 2006, section 171.02, subdivision 1, is amended to read:
1.21    Subdivision 1. License required; duplicate identification restricted. (a) Except
1.22when expressly exempted, a person shall not drive a motor vehicle upon a street or
2.1highway in this state unless the person has a license valid license under this chapter for
2.2the type or class of vehicle being driven.
2.3    (b) The department shall not issue a driver's license to a person unless and until the
2.4person's license from any jurisdiction has been invalidated. The department shall provide
2.5to the issuing department of any jurisdiction, information that the licensee is now licensed
2.6in Minnesota. A person is not permitted to have more than one valid driver's license
2.7at any time. The department shall not issue to a person to whom a current Minnesota
2.8identification card has been issued a driver's license, other than a limited license, unless
2.9the person's Minnesota identification card has been invalidated. This subdivision does
2.10not require invalidation of a tribal identification card as a condition of receiving a driver's
2.11license.
