  1.1                          A bill for an act 
  1.2             relating to education finance; establishing permanent 
  1.3             funding for gifted and talented programs as a 
  1.4             component of general education revenue; appropriating 
  1.5             money; amending Minnesota Statutes 2000, section 
  1.6             126C.10, subdivision 1, and by adding a subdivision. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2000, section 126C.10, 
  1.9   subdivision 1, is amended to read: 
  1.10     Subdivision 1.  [GENERAL EDUCATION REVENUE.] For fiscal 
  1.11  year 2000 2002 and thereafter, the general education revenue for 
  1.12  each district equals the sum of the district's basic revenue, 
  1.13  basic skills revenue, gifted and talented revenue, training and 
  1.14  experience revenue, secondary sparsity revenue, elementary 
  1.15  sparsity revenue, transportation sparsity revenue, total 
  1.16  operating capital revenue, equity revenue, referendum offset 
  1.17  adjustment, transition revenue, and supplemental revenue. 
  1.18     [EFFECTIVE DATE.] This section is effective for revenue for 
  1.19  fiscal years 2002 and later. 
  1.20     Sec. 2.  Minnesota Statutes 2000, section 126C.10, is 
  1.21  amended by adding a subdivision to read: 
  1.22     Subd. 29.  [GIFTED AND TALENTED REVENUE.] (a) Gifted and 
  1.23  talented revenue for each school district equals $10 times the 
  1.24  district's adjusted marginal cost pupil units.  
  1.25     (b) Gifted and talented revenue must be used to: 
  1.26     (1) develop a local process which will identify or 
  2.1   designate no less than ten percent of its total enrollment for 
  2.2   gifted and talented services; and 
  2.3      (2) provide additional staff development training to 
  2.4   deliver gifted and talented instruction. 
  2.5      (c) Districts must report to the local school board each 
  2.6   year and report to the commissioner every odd-numbered year on 
  2.7   the expenditures and outcomes of the program in a form and 
  2.8   manner determined by the commissioner. 
  2.9      [EFFECTIVE DATE.] This section is effective for revenue for 
  2.10  fiscal years 2002 and later. 
  2.11     Sec. 3.  [COMMISSIONER DUTIES.] 
  2.12     The commissioner of children, families, and learning shall 
  2.13  establish a division of gifted and talented services within the 
  2.14  department of children, families, and learning beginning in 
  2.15  fiscal year 2002.  The division shall: 
  2.16     (1) provide general oversight to the gifted and talented 
  2.17  revenue program; 
  2.18     (2) provide support and start-up assistance for districts 
  2.19  that do not have gifted and talented programs; 
  2.20     (3) develop a set of criteria for best practice gifted and 
  2.21  talented instruction and assist districts in providing 
  2.22  professional development in gifted and talented instruction; 
  2.23     (4) assist districts in developing processes for 
  2.24  identifying and assessing students for placement in appropriate 
  2.25  gifted and talented services; 
  2.26     (5) assist districts in developing gifted and talented 
  2.27  services that are integrated with the state's graduation 
  2.28  standards; 
  2.29     (6) by July 1, 2002, develop a state accountability system 
  2.30  with district outcomes for gifted and talented programs; and 
  2.31     (7) by July 1, 2002, develop a uniform system of reporting 
  2.32  program expenses and results to the state and to the local 
  2.33  school board. 
  2.34     [EFFECTIVE DATE.] This section is effective July 1, 2001. 
  2.35     Sec. 4.  [APPROPRIATION.] 
  2.36     $....... in fiscal year 2002 and $....... in fiscal year 
  3.1   2003 are appropriated from the general fund to the commissioner 
  3.2   of children, families, and learning to establish and provide 
  3.3   appropriate staffing for the division of gifted and talented 
  3.4   services within the department of children, families, and 
  3.5   learning.
