A bill for an act
relating to elections; prohibiting electioneering in or near a polling place; amending
Minnesota Statutes 2020, section 211B.11, subdivision 1.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2020, section 211B.11, subdivision 1, is amended to read:


Subdivision 1.

Soliciting near polling places.

new text begin (b) new text end Nothing in this subdivision prohibits the distribution of "I VOTED" stickers as
provided in section 204B.49.

new text begin (c) For purposes of this section, "electioneer" means trying to induce or persuade a voter
to vote for or refrain from voting for a candidate or question that appears on the ballot at
the election by any of the following actions:

new text begin (1) displaying campaign material;
new text end

new text begin (2) posting signs;
new text end

new text begin (3) asking for, requesting, or soliciting a particular vote;
new text end

new text begin (4) wearing or displaying apparel, buttons, stickers, or pins that include the name or logo
of a candidate or political party that appears on the ballot; or

new text begin (5) wearing or displaying apparel, buttons, stickers, or pins that directly reference a
question that appears on the ballot.

new text begin This section is effective July 1, 2021, and applies to elections
held on or after that date.
