1.1 A bill for an act 1.2 relating to local government; allowing abolition of a 1.3 city public utilities commission or utility transfer 1.4 to city council by ordinance; amending Minnesota 1.5 Statutes 2000, section 412.391, subdivisions 1 and 4; 1.6 repealing Minnesota Statutes 2000, section 412.391, 1.7 subdivisions 2 and 3. 1.8 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.9 Section 1. Minnesota Statutes 2000, section 412.391, 1.10 subdivision 1, is amended to read: 1.11 Subdivision 1. [TO COUNCIL; PROCEDURE.]TheA statutory 1.12 city may abolish by ordinance its public utilities commissionof1.13any statutory city may be abolishedoritsmay transfer to the 1.14 council by ordinance the public utilities commission's 1.15 jurisdiction over any particular utilitytransferred to the1.16council by following the procedure prescribed in this section. 1.17 Sec. 2. Minnesota Statutes 2000, section 412.391, 1.18 subdivision 4, is amended to read: 1.19 Subd. 4. [TIME OF EFFECT.]If a majority of the votes cast1.20on a proposition submitted to the voters under subdivision 2 or1.213 is in the affirmative,The provisions of sections 412.331 to 1.22 412.381 shall cease to apply to the city, in the case of an 1.23election under subdivision 2ordinance abolishing the public 1.24 utilities commission, or to the particular utility mentioned in 1.25 theproposition submitted to the votersordinance, in the case 1.26 of anelection under subdivision 3ordinance transferring 2.1 jurisdiction to the council. Such change shall take place 30 2.2 days after theelectioneffective date of the ordinance. 2.3 Sec. 3. [REPEALER.] 2.4 Minnesota Statutes 2000, section 412.391, subdivisions 2 2.5 and 3, are repealed.
