A bill for an act
relating to transportation; requiring commissioner of transportation to reconvey
encroached-upon right-of-way along marked Trunk Highway 23.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin CONVEYANCE OF STATE INTEREST IN REAL PROPERTY.

new text begin (a) Notwithstanding Minnesota Statutes, sections 16B.281 to 16B.287, or any other
law to the contrary, the commissioner of transportation shall convey and quitclaim the
parcel of land described in paragraph (b) to an individual who owns private property that
is adjacent to marked Trunk Highway 23 and who owns the structure located, in part,
within the right-of-way of marked Trunk Highway 23.

new text begin (b) The parcel of land to be conveyed is located in Stearns County and consists of
that portion of the right-of-way of marked Trunk Highway 23 containing a structure
encroaching upon the right-of-way and not owned by the commissioner of transportation,
plus an additional one foot around the structure, where the structure is located on lots 7
and 8, block 5, plat 70015, Oak Park Addition in Paynesville (parcel #7039217000).

attorney general may make necessary changes to the legal description to correct errors
and ensure accuracy.
