  1.1                          A bill for an act
  1.2             relating to education finance; authorizing a levy for 
  1.3             certain hazardous pupil transportation services; 
  1.4             amending Minnesota Statutes 2002, section 123B.92, by 
  1.5             adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 123B.92, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 11.  [HAZARDOUS TRANSPORTATION LEVY.] (a) Upon 
  1.10  approval of a referendum under paragraph (c), a school board may 
  1.11  annually levy the amounts necessary to provide transportation 
  1.12  services to students facing hazardous transportation conditions. 
  1.13     (b) Hazardous transportation conditions must be defined by 
  1.14  the school board and may include the following factors:  the 
  1.15  volume and speed of traffic; the types of roads and streets that 
  1.16  students must cross; the time of day that students are traveling 
  1.17  to and from school; the age of the students; and any other 
  1.18  relevant traffic conditions identified by the school board.  
  1.19     (c) A district may conduct a referendum under section 
  1.20  126C.17, subdivision 9, for the purpose of authorizing a 
  1.21  hazardous transportation levy.  Amounts approved are in addition 
  1.22  to any other amounts under section 126C.17 and are not subject 
  1.23  to referendum allowance limits of that section.  Amounts 
  1.24  approved under this section are not eligible for equalization 
  1.25  aid. 
  2.1      [EFFECTIVE DATE.] This section is effective for taxes 
  2.2   payable in 2004.
